                                     AN ACT

     1  Amending Title 51 (Military Affairs) of the Pennsylvania
     2     Consolidated Statutes, further providing for the issuance of
     3     a United States flag for certain deceased members of the
     4     Pennsylvania National Guard and the Pennsylvania Guard.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 51 (Military Affairs), act of November 25,
     8  1970 (P.L.707, No.130), known as the Pennsylvania Consolidated
     9  Statutes, is amended by adding a section to read:
    10  § 3705.  Duty to furnish United States flag.
    11     (a)  General rule.--The department shall furnish a United
    12  States flag to drape the casket of each deceased member who at
    13  the time of death was:
    14         (1)  An active member of the Pennsylvania National Guard
    15     or the Pennsylvania Guard.
    16         (2)  Is a retired member of the Pennsylvania National
    17     Guard or the Pennsylvania Guard.
    18         (3)  Was discharged from the Pennsylvania National Guard

     1     or the Pennsylvania Guard for a disability incurred or
     2     aggravated in the line of duty.
     3     (b)  Exemption.--Any member eligible for a burial flag under
     4  the provisions of 38 United States Code § 901 (relating to
     5  flags) is not authorized to receive the United States flag under
     6  the provisions of this section.
     7     (c)  Appropriation for cost.--The necessary appropriations to
     8  pay for any flags issued under this section shall, at each
     9  regular session of the General Assembly, be included in the
    10  items pertaining to the department, in the act of Assembly
    11  providing for the ordinary expenses of the Executive, Judicial
    12  and Legislative Departments of the Commonwealth.
    13     Section 2.  This act shall take effect immediately.
