                                     AN ACT

     1  Amending the act of May 9, 1949 (P.L.927, No.261), entitled, as
     2     amended, "An act fixing and regulating the fees, commissions,
     3     mileage and other costs chargeable by the sheriff in counties
     4     of the second, second A, third, fourth, fifth, sixth, seventh
     5     and eighth classes for their official acts and the services
     6     of their deputies, watchmen, appraisers and other agents;
     7     requiring prepayment of same, unless secured or chargeable to
     8     the county, and delivery of itemized receipts therefor;
     9     requiring certain payments by the county, including the
    10     compensation of special deputies; providing for the taxation
    11     and collection of fees, commissions, mileage and other costs;
    12     requiring salaried sheriffs to account to the county for
    13     certain fees and commissions collected; and repealing
    14     inconsistent laws, general, special or local," changing fees.

    15     The General Assembly of the Commonwealth of Pennsylvania
    16  hereby enacts as follows:
    17     Section 1.  Section 1, act of May 9, 1949 (P.L.927, No.261),
    18  referred to as the Sheriff Fee Law of 1949, amended July 21,
    19  1970 (P.L.500, No.175), and subsections (d), (j) and (l) amended
    20  October 17, 1974 (P.L.752, No.253), is amended to read:
    21     Section 1.  In all counties of the second, second A, third,
    22  fourth, fifth, sixth, seventh and eighth classes, the fees and
    23  costs, including commissions and mileage, to be charged and
    24  received by the sheriff from persons or counties requiring their

     1  services shall be as follows:
     2     (a)  For receiving, docketing, and making return thereof, for
     3  each writ of execution, scire facias, replevin, retorno habendo,
     4  summons, foreign attachment, complaint in divorce, distringas,
     5  writ of sequestration, writ of assistance, satisfaction of
     6  mortgage, injunction, mandamus, quo warranto, bill in equity,
     7  rule, decree, order, citation, subpoena, series of
     8  interrogatories, proclamation, or official notice of any kind in
     9  any civil action, criminal proceeding, or public matter, issued
    10  out of any court or required by law or rule of court, [four
    11  dollars seventy-five cents] five dollars seventy-five cents.
    12     For serving any such writ, process or official notice
    13  required to be served by the sheriff, personally or by copy
    14  served or posted, [four dollars] five dollars.
    15     For each additional defendant or person served, or copy
    16  posted, two dollars and mileage.
    17     For making each copy served or posted, two dollars.
    18     For return of tarde venit, two dollars fifty cents.
    19     For return of non est inventus, two dollars fifty cents and
    20  mileage.
    21     Provided, however, That no charge for service shall be made
    22  upon an alias or pluries writ if the same has been charged upon
    23  the original with respect to any defendant already served.
    24     For serving the same by publication in one or more
    25  newspapers, as required by law or order of court, [three dollars
    26  fifty cents] five dollars in each case, in addition to printer's
    27  bills.
    28     For serving any writ, official notice, petition, rule,
    29  decree, process, or order of court, or copy thereof, not herein
    30  specially provided for, he shall charge and receive the same

     1  official fees and legal costs, including mileage, as for a writ
     2  served in a similar way, as hereinbefore provided, in addition
     3  to any fee of the prothonotary chargeable against the sheriff in
     4  relation thereto; but no charge shall be made for any affidavit
     5  of such service, except the fee of the notary or other official
     6  administering the oath or affirmation thereto. For taking an
     7  affidavit, one person, [fifty cents] one dollar; two persons,
     8  [seventy-five cents] three dollars; three or more, [one dollar]
     9  five dollars.
    10     (b)  For executing writs of execution, or any writ or order
    11  issued out of any court, requiring the levy and seizure of lands
    12  and tenements or selling the same according to law, the
    13  following items, to be paid by the plaintiffs or petitioners:
    14     For receiving, docketing, and making return thereof, [four
    15  dollars seventy-five cents] five dollars seventy-five cents.
    16     For serving or posting any copy or notice thereof, [four
    17  dollars] five dollars and mileage hereinbefore provided.
    18     For levying on each separate piece or parcel of land, [two
    19  dollars twenty-five cents] five dollars and mileage.
    20     For advertising to public sale in newspapers, each piece or
    21  parcel of land, [three dollars fifty cents] five dollars, in
    22  addition to printer's bills.
    23     For advertising to public sale by hand-bills, each piece or
    24  parcel of land separately described by metes and bounds, or
    25  otherwise [three dollars fifty cents] five dollars and mileage,
    26  in addition to printer's bills.
    27     For crying the sale of each separate piece or parcel of land
    28  separately sold, and each adjourned sale, [three dollars] five
    29  dollars.
    30     In addition, the sheriff shall charge and receive, as an

     1  official fee, a commission charge of two cents on every dollar,
     2  based upon the total amount bid for the property, whether paid
     3  to the sheriff or credited to the purchaser: Provided, That the
     4  amount of same does not exceed one thousand dollars ($1000), in
     5  which case one-half cent (1/2¢) on every dollar in excess of
     6  this amount shall be charged in addition.
     7     For executing and acknowledging any deed for lands and
     8  tenements, [six dollars] ten dollars, to be paid by the
     9  purchaser when the deed is tendered.
    10     For registering the same, in any municipality, [one dollar
    11  fifty cents] ten dollars, in addition to the fee required by law
    12  for registration, to be paid by the purchaser.
    13     In addition, the purchaser shall pay to the sheriff any fee
    14  of the prothonotary for the acknowledgment of the sheriff's
    15  deed, and the fee of the recorder for recording same, for which
    16  the sheriff shall account to them, respectively.
    17     (c)  For executing any writ of inquiry, partition,
    18  condemnation, appraisement, inquisition, or any similar writ,
    19  issued by any court, alderman, justice of the peace, magistrate
    20  or commissioner, under any act of Assembly, the following items,
    21  to be paid by the party who procured same:
    22     For receiving, docketing, and making return thereof, [three
    23  dollars and seventy-five cents] six dollars seventy-five cents.
    24     For summoning parties or persons in possession, personally or
    25  by copy served or posted, for first service, [two dollars fifty
    26  cents] five dollars.
    27     For each additional service, personally or by copy or
    28  posting, [one dollar fifty cents] two dollars fifty cents and
    29  mileage.
    30     For making each copy served or posted, [one dollar fifty

     1  cents] two dollars.
     2     For summoning and swearing special jurors, [five dollars] ten
     3  dollars.
     4     For holding inquisition or appraisement of real estate, if
     5  same be held upon the premises, six dollars and mileage to and
     6  from the place where same may be located, in addition to
     7  jurors', experts', or surveyors' fees and necessary expenses.
     8     For other execution of any such writ, five dollars.
     9     For serving the same by publication in one or more
    10  newspapers, as required by law or order of court, [three
    11  dollars] six dollars, in addition to printer's bills.
    12     For delivering lands to plaintiff in inquisition or similar
    13  proceedings [three dollars] six dollars and mileage, and no
    14  commission in such case shall be charged.
    15     (d)  For executing execution writs, fraudulent debtors
    16  attachment, retorno habendo, and replevin, or any writ or order
    17  issued out of any court requiring the levy or seizure of
    18  personal property or selling the same according to law, the
    19  following items, to be paid by the parties procuring same:
    20     For receiving, docketing, and making return thereof, [four
    21  dollars seventy-five cents] five dollars seventy-five cents.
    22     For serving or posting any copy or notice thereof, [the fees
    23  and mileage hereinbefore provided] seven dollars fifty cents.
    24     For each levy on personal property, [three dollars and
    25  seventy-five cents] five dollars and mileage.
    26     For return of nulla bona, [two dollars] five dollars and
    27  mileage.
    28     For clerk hire at each sale, whether on one or more writs
    29  against the same defendant, four dollars.
    30     For advertising personal property to public sale by hand-

     1  bills, [three dollars and seventy-five cents] five dollars and
     2  mileage, in addition to printer's bills.
     3     For adjourning any sale, [three dollars] five dollars and
     4  mileage.
     5     In addition, the sheriff shall charge and receive, as an
     6  official fee, a commission of two cents on every dollar, based
     7  upon the total amount realized from said sale, whether paid to
     8  the sheriff or credited to the purchaser on account of any writ:
     9  Provided, That the amount of same does not exceed one thousand
    10  dollars ($1000), in which case one-half cent (1/2¢) on every
    11  dollar in excess of that amount shall be charged in addition.
    12     For each watchman to take care of property attached, levied
    13  upon, or otherwise taken into legal custody, when necessary, or
    14  requested by any of the parties interested, thirty dollars for
    15  each period of eight hours, to be considered a day's service,
    16  and a proportionate sum for any fraction of such day, to be
    17  payable to such watchman, and collectible for his benefit by the
    18  sheriff from the party benefited thereby, or person requiring
    19  his services, in like manner as other legal costs payable to the
    20  sheriff may be collected.
    21     For insurance, arranging goods for sale, heat, light, power,
    22  storage, rent, transportation, supplies, feeding livestock, and
    23  similar expenses, incurred in caring for and keeping the goods
    24  and chattels levied upon or attached, when the same are
    25  necessary or advantageous, or when requested by any party
    26  interested to incur any such expenses, the actual costs thereof,
    27  to be paid by the plaintiff, petitioner, or party requiring same
    28  to be incurred, provided any surplus of advances for same be
    29  refunded.
    30     (e)  For the settlement or staying by the plaintiff of any

     1  writ embraced in any section of this act, relating to either
     2  lands and tenements or personal property, the execution of the
     3  same not being concluded, the sheriff shall receive the same
     4  fees for receiving, docketing, and returning, levying and
     5  advertising, with mileage and such commission as would be
     6  chargeable if sale had been made upon said writ for the amount
     7  paid to settle or stay the same, whether such sum be paid to him
     8  or to the plaintiff, or a compromise be made between plaintiff
     9  and defendant for the future payment of any sum to satisfy the
    10  same.
    11     For receiving and docketing each property claim, wage claim,
    12  rent claim, or exemption claim, [four dollars] six dollars, to
    13  be paid by the claimant upon filing same with the sheriff or his
    14  deputy, in addition to any fee collectible by the prothonotary
    15  or clerk of any court for filing any notice, petition or rule
    16  relating thereto.
    17     For the appraisement of personal property by virtue of any
    18  act of Assembly, or at the lawful request of any party, [six
    19  dollars] seven dollars and mileage: Provided, That in any case
    20  where the appraisement of a large quantity of goods or the
    21  services of experts shall be required, the sheriff, or any
    22  party, may apply by petition to the court, or a judge thereof,
    23  having jurisdiction over said matter, setting forth the facts;
    24  and said court or judge may make an order fixing the sum to be
    25  allowed and paid to the sheriff for the compensation of the
    26  appraisers, as the proper cost of making such appraisement,
    27  which sum, so fixed and allowed, shall be taxed as the sheriff's
    28  proper legal costs. The plaintiff or petitioner in the
    29  proceedings shall pay for the making and filing of any
    30  appraisement required, unless otherwise provided by law.

     1     For notifying the Auditor General of the proposed sale of the
     2  property or the franchise of any corporation or joint-stock
     3  association, [four dollars] five dollars.
     4     (f)  For executing venire facias or venire facias jurotores
     5  issued out of any court, the following items, to be paid by the
     6  county:
     7     For receiving, docketing, and making return thereof, on each
     8  venire, [four dollars] five dollars.
     9     For any services of the sheriff in drawing names of jurors
    10  from the jury wheel and summoning such jurors, or summoning any
    11  jurors drawn by any jury board or commissioner, the sheriff
    12  shall be entitled to charge and receive from the county, one
    13  dollar fifty cents and mileage, and necessary expenses, for each
    14  juror drawn.
    15     (g)  For executing writs of execution, dower, possessionem,
    16  or possessory process, requiring the delivery of possession of
    17  real estate, or ejecting or dispossessing any person or persons
    18  of their effects, [seven dollars] ten dollars and mileage, and
    19  reasonable costs for help, when necessary to preserve the peace
    20  or safeguard property, in addition to the costs of sale when
    21  made, to be paid by the party depositing such writ or demanding
    22  possession.
    23     (h)  For executing any process, warrant, capias, attachment,
    24  decree, sentence or order of court, issued out of any court,
    25  where any person or the defendant's body is taken into custody,
    26  to be paid by the county when the Commonwealth is interested,
    27  otherwise by the party procuring such process, writ, order or
    28  decree, as follows:
    29     For receiving, docketing, and making return thereof, [four
    30  dollars] five dollars.

     1     For each arrest, [three dollars] five dollars and mileage, in
     2  addition to necessary help and expenses, including the
     3  compensation of any special deputies required, who shall be paid
     4  at the rate of [ten dollars] thirty dollars for eight hours'
     5  service.
     6     For transportation of all prisoners, [twelve cents] fifteen
     7  cents per mile per round trip, in addition to necessary help and
     8  expenses, including the compensation of any special deputies
     9  required, who shall be paid at the rate of [twenty dollars]
    10  thirty dollars for eight hours' service.
    11     For each commitment to jail, correctional institution,
    12  asylum, or place of detention of any juvenile court, in any
    13  criminal or civil case, [one dollar] five dollars, to be paid by
    14  the county, unless otherwise provided by law.
    15     For discharging any person or prisoner from any such place of
    16  confinement, in any case, [one dollar] five dollars, to be paid
    17  by the county.
    18     For executing bail-piece or taking bond in any matter,
    19  whether civil or criminal, [two dollars] five dollars, to be
    20  paid by the person benefited, unless otherwise provided by law.
    21     In addition, the sheriff shall receive for the indictment, in
    22  each oyer and terminer case, the sum of [four dollars] five
    23  dollars; and in each quarter sessions court, or other county
    24  court case, the sum of [two dollars] five dollars, to be paid by
    25  the county.
    26     For each bill ignored by the grand jury, [two dollars] five
    27  dollars, to be paid by the county.
    28     For each case acted upon by any juvenile court, [two dollars]
    29  five dollars to be paid by the county.
    30     For each non-support or desertion case acted upon by any

     1  court, the sum of [two dollars] five dollars, to be paid by the
     2  county.
     3     (i)  Where the sheriff shall be in charge of any jail or
     4  prison or place of detention, he shall be entitled to receive
     5  such allowance for the custody, care and maintenance of
     6  prisoners and inmates as may be fixed by the courts or official
     7  boards of the respective counties having supervision of such
     8  institutions, or as said courts or boards may approve, upon
     9  itemized bills rendered from time to time, to be paid by such
    10  county, in addition to any compensation for his services fixed
    11  by law or by any court or official board authorized to fix such
    12  compensation.
    13     For removing an insane or weak minded or defective person to
    14  any institution for the confinement of any such persons, or any
    15  person to the penitentiary, workhouse, Huntingdon Reformatory,
    16  or to any charitable institution, or any hospital, school, or
    17  home where persons are confined or detained or supported, under
    18  any commitment, sentence or order of any court, [five dollars]
    19  ten dollars on each commitment or order, in addition to mileage
    20  and necessary expenses, including the compensation of any
    21  special deputies required, who shall be paid at the rate of
    22  [twenty dollars] thirty dollars for eight hours' service, to be
    23  paid by the county unless some other governmental body is
    24  chargeable therewith by law: Provided, however, That the mileage
    25  for the person in custody, under commitment or order, shall be
    26  based upon the miles actually traveled to his or her
    27  destination.
    28     (j)  For attending court, when required to do so by law or by
    29  any judge or district attorney, or bringing into and removing
    30  therefrom prisoners for arraignment, trial, or sentence, or

     1  witnesses held in custody, the sum of thirty dollars per day for
     2  the sheriff, and a like sum for each deputy, for each day of
     3  court of common pleas (criminal division), juvenile court, or
     4  county court, including the County Court of Allegheny County,
     5  when the sheriff or deputy is actually present, to be paid by
     6  the county.
     7     (k)  For issuing and recording any license, two dollars, in
     8  addition to the license fee, payable to the county or
     9  Commonwealth, to be paid by the licensee.
    10     (l)  For services performed in his capacity as a conservator
    11  of the peace or police officer, in suppressing riots, mobs or
    12  insurrections, and when discharging any duty requiring the
    13  summoning of a posse comitatus or special deputy sheriffs, the
    14  sheriff shall receive per diem compensation at the rate of
    15  thirty dollars in any county for eight hours' service, together
    16  with the mileage and necessary expenses, including subsistence
    17  for himself and those under him, to be paid by the county.
    18     For each special deputy appointed by any sheriff, in case of
    19  any emergency, to assist him in executing any civil or criminal
    20  process or court order, or preserving the peace, such sheriff
    21  may charge and shall receive from the county compensation for
    22  such deputy, at the rate of three dollars seventy-five cents in
    23  any county for one hour's service, in addition to the expenses
    24  incurred for the transportation and subsistence of such deputy
    25  while rendering such service.
    26     (m)  For mileage in serving or executing any of the writs,
    27  official notices, rules, decrees, orders or processes, or copies
    28  thereof, or performing any of the duties or services herein
    29  specified or authorized by law, the sheriff shall be entitled to
    30  charge and receive, and may tax as official costs, twelve cents

     1  a mile circular for each mile necessary to be traveled by him or
     2  any of his deputies or employes, and the same shall be allowed
     3  upon each separate writ, rule, order, decree, process or notice
     4  served, or service performed: Provided, That he shall not
     5  receive more than one mileage where the plaintiff and defendant
     6  in two or more contemporaneous writs are the same, or when
     7  conducting two or more persons or prisoners at one time to or
     8  from a place of detention or correction, but he shall also
     9  receive the aforesaid mileage for transporting such prisoners
    10  and his deputies guarding them, and meals and lodging during the
    11  journey and the return of his deputies.
    12     (n)  For the executing of any matter directed to the sheriff,
    13  or required by law or rule of court, the performance of which is
    14  not herein mentioned, the sheriff shall receive the same
    15  official fees, commissions and legal costs, including mileage,
    16  as for similar service herein specially provided for.
    17     (o)  In all cases or proceedings of which the County Court of
    18  Allegheny County shall have jurisdiction, the sheriff shall
    19  receive the same fees, commissions and costs, including mileage,
    20  for official services in connection therewith as for similar
    21  services in like proceedings in other courts of the
    22  Commonwealth.
    23     Section 2.  This act shall take effect in 60 days.
