                                     AN ACT

     1  Amending the act of August 9, 1955 (P.L.323, No.130), entitled
     2     "An act relating to counties of the third, fourth, fifth,
     3     sixth, seventh and eighth classes; amending, revising,
     4     consolidating and changing the laws relating thereto," adding
     5     duties of the county solicitor.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Section 902, act of August 9, 1955 (P.L.323,
     9  No.130), known as "The County Code," amended June 7, 1961
    10  (P.L.245, No.141), is amended to read:
    11     Section 902.  Duties.--He shall commence and prosecute all
    12  suits brought, or to be brought, by the county, wherein or
    13  whereby any rights, privileges, properties, claims or demands of
    14  the county are involved, as well as defend all actions or suits
    15  brought against the county, and shall perform all duties now
    16  enjoined by law upon county solicitors, and shall do all and
    17  every professional act and render legal advice incident to the
    18  office which may be required of him by the commissioners. He
    19  shall, in addition, perform all similar duties for each elected
    20  officer who is not authorized to appoint a solicitor or who has

     1  not appointed a solicitor although authorized to do so. In case
     2  of any litigation, impending or in progress, between the
     3  commissioners and any other elected county officer, the proper
     4  court may authorize such county officer to retain special
     5  counsel for the said purpose, whose fee shall be fixed by the
     6  court and paid from the county treasury.
     7     Section 2.  This act shall take effect immediately.
