        SENATOR LEWIS, LOCAL GOVERNMENT, IN SENATE, AS AMENDED,
           JUNE 27, 1977

                                     AN ACT

     1  Amending the act of May 1, 1933 (P.L.103, No.69), entitled "An
     2     act concerning townships of the second class; and amending,
     3     revising, consolidating, and changing the law relating
     4     thereto," changing population requirements for additional
     5     supervisors.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  Subsection (B) of section 402, act of May 1, 1933
     9  (P.L.103, No.69), known as "The Second Class Township Code,"
    10  reenacted and amended July 10, 1947 (P.L.1481, No.567), and
    11  amended July 30, 1975 (P.L.134, No.67), is amended to read:
    12     Section 402.  Officers to Be Elected.--* * *
    13     (B)  Upon petition of at least five per centum of the
    14  registered electors of the township or pursuant to a resolution
    15  of the board of supervisors, and upon an approval by a majority
    16  of those electors voting at the next municipal or general
    17  election, there shall be elected two additional supervisors. [in  <--
    18  any township having a population of [three] two thousand or more  <--


     1  as determined by an official census taken by the Federal
     2  Government for any purpose or as determined by any other census
     3  which is certified by the County Planning Commission of said
     4  county.] The referendum petition or resolution of the board of    <--
     5  supervisors certified by the township secretary shall be filed
     6  with the county board of elections not later than the thirteenth
     7  Tuesday prior to the next municipal or general election. The
     8  county board of elections shall place the question before the
     9  electors in the same manner as other questions are presented
    10  under the provisions of the Pennsylvania Election Code.
    11  The form of the question shall be as follows:
    12  Should two additional supervisors be                      Yes
    13  elected to serve in this township?                        No
    14  The county board of elections shall tabulate and publish the
    15  results of the referendum within thirty days of the election.
    16  The total number of supervisors shall not exceed five.
    17     Section 2.  Section 410 of the act, amended July 16, 1975
    18  (P.L.73, No.43), is amended to read:
    19     Section 410.  Supervisors.--Except as is otherwise provided
    20  for the election of additional supervisors, [in townships having  <--
    21  a population of [three] two thousand or more,] at each municipal  <--
    22  election, the electors of each township shall elect one
    23  supervisor to serve for a term of six years from the first
    24  Monday of January next following his election.
    25     Except as provided in section 514, no supervisor shall at the
    26  time hold any other elective or appointive township office or
    27  position other than township roadmaster or secretary-treasurer.
    28     Section 3.  This act shall take effect in 60 days.
