           SEPTEMBER 20, 1978

                                     AN ACT

     1  Amending the act of June 22, 1931 (P.L.720, No.262), entitled
     2     "An act providing for the taking over by the Commonwealth,
     3     under certain terms, conditions and limitations, of certain
     4     streets in cities of the second class, second class A, and
     5     third class as State highways, and for the improvement,
     6     construction, reconstruction, resurfacing and maintenance by
     7     the Commonwealth of certain defined widths of said streets;
     8     imposing duties on such cities and on public utility
     9     companies using such streets; providing that no assessment
    10     shall be made upon the Commonwealth in the elimination of any
    11     grade crossing thereon; authorizing cities, persons,
    12     associations, or corporations to enter into agreements with
    13     the Commonwealth to bear a portion of the cost of
    14     construction or maintenance; providing for the assessment of
    15     certain portions of the cost of street improvements on
    16     abutting property owners; regulating the replacement of
    17     certain facilities of public utility companies; prohibiting
    18     the opening of said streets after improvement without a
    19     permit, and providing penalty therefor; regulating the
    20     maintenance of detours; authorizing the increase of city
    21     indebtedness in certain cases; and appropriating money in the
    22     Motor License Fund for the purposes of this act," changing
    23     certain routes in the City of Washington.

    24     The General Assembly of the Commonwealth of Pennsylvania
    25  hereby enacts as follows:
    26     Section 1.  The following routes established in section 2,
    27  act of June 22, 1931 (P.L.720, No.262), entitled "An act
    28  providing for the taking over by the Commonwealth, under certain


     1  terms, conditions and limitations, of certain streets in cities
     2  of the second class, second class A, and third class as State
     3  highways, and for the improvement, construction, reconstruction,
     4  resurfacing and maintenance by the Commonwealth of certain
     5  defined widths of said streets; imposing duties on such cities
     6  and on public utility companies using such streets; providing
     7  that no assessment shall be made upon the Commonwealth in the
     8  elimination of any grade crossing thereon; authorizing cities,
     9  persons, associations, or corporations to enter into agreements
    10  with the Commonwealth to bear a portion of the cost of
    11  construction or maintenance; providing for the assessment of
    12  certain portions of the cost of street improvements on abutting
    13  property owners; regulating the replacement of certain
    14  facilities of public utility companies; prohibiting the opening
    15  of said streets after improvement without a permit, and
    16  providing penalty therefor; regulating the maintenance of

    20     Section 2.  The city streets to be taken over, under the
    21  provisions of this act, in the cities hereinafter named, shall
    22  be designated by numbers, to be hereafter assigned by the
    23  Secretary of Highways, and are situate and described as follows:

    25     L.R.109. Beginning at a point on the intersection of           <--
    26  [Jefferson Avenue and West Chestnut Street; thence over
    27  Jefferson Avenue to West Beau Street; thence over West Beau
    28  Street to Franklin Street; thence on Franklin Street to West
    29  Maiden Street; thence on West Maiden Street to South Main
    30  Street; thence on] South Main Street [to] and Park Avenue;

     1  thence along Park Avenue to the dividing line between the city
     2  of Washington and North Franklin Township, in the City of
     3  Washington, a distance of about [1.03] .41 miles.
     4     L.R.113. Beginning at a point on the boundary line between
     5  the City of Washington and South Strabane Township, on East
     6  Maiden Street; thence over East Maiden Street to Main Street;
     7  [thence over Main Street to the intersection with Beau Street,]
     8  continuing over Maiden Street, crossing Strawberry Avenue,
     9  Wheeling Street, Cherry Avenue and Beau Street, to the
    10  intersection with Chestnut Street, in the City of Washington, a
    11  distance of about [1.5] 1.84 miles.
    12     L.R.114. Beginning at a point on the intersection of [Main
    13  Street and Beau Street; thence over Main Street to Chestnut
    14  Street; thence over] College Street and Chestnut Street; thence
    15  in a westerly direction over Chestnut Street and West Chestnut
    16  Street to the line dividing the City of Washington and townships
    17  of Canton and North Franklin, in the City of Washington, a
    18  distance of about [1.4] 1.44 miles.

    20     L.R.181. Beginning at a point on East Beau Street, at the
    21  dividing line between the City of Washington and East Washington
    22  Borough; thence over East Beau Street to [Main Street,] College
    23  Street, in the City of Washington, a distance of about [.38] .24

    26     L.R.114 SPUR.  BEGINNING AT A POINT ON NORTH MAIN STREET, ON   <--
    27  THE DIVIDING LINE BETWEEN THE CITY OF WASHINGTON AND SOUTH
    28  STRABANE TOWNSHIP; THENCE OVER NORTH MAIN STREET TO AN
    29  INTERSECTION AT NORTH MAIN AND [CHESTNUT] WALNUT STREETS, THENCE
    30  EASTERLY OVER WALNUT STREET TO THE INTERSECTION OF WALNUT AND

     1  COLLEGE STREETS, A DISTANCE OF ABOUT 0.8 OF A MILE.
     2     SECTION 2.  (A)  THE COMMONWEALTH OF PENNSYLVANIA SHALL CEDE
     3  CONTROL TO THE CITY OF WASHINGTON THE FOLLOWING STREETS:
     4     (1)  MAIN STREET BETWEEN BEAU STREET AND MAIDEN STREET, A
     5  DISTANCE OF .216 MILES.
     6     (2)  BEAU STREET BETWEEN MAIN STREET AND COLLEGE STREET, A
     7  DISTANCE OF .125 MILES.
     8     (3)  MAIN STREET BETWEEN CHESTNUT STREET AND WALNUT STREET A
     9  DISTANCE OF .094 MILES.
    10     (4)  MAIN STREET BETWEEN CHESTNUT STREET AND BEAU STREET, A
    11  DISTANCE OF .1089 MILES.
    12     (B)  THE CITY OF WASHINGTON SHALL TRANSFER TO THE CONTROL OF
    13  THE COMMONWEALTH OF PENNSYLVANIA THE FOLLOWING STREET: CHESTNUT
    14  STREET BETWEEN MAIN STREET AND COLLEGE STREET, A DISTANCE OF
    15  .127 MILES.
    16     Section 2 3.  This act shall take effect immediately.          <--
