AN ACT
1 Providing for reimbursement of costs incurred by volunteer fire
2 and ambulance companies for services rendered on Commonwealth
3 property including legal costs arising therefrom; requiring
4 the Department of Justice to provide legal representation in
5 certain cases; and making an appropriation.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. The Commonwealth recognizes the desirability and
9 value of services performed in its behalf by volunteer fire
10 companies and volunteer ambulance companies within this
11 Commonwealth. The purpose of this act is to facilitate such
12 service and to encourage its continued availability.
13 Section 2. Each and every volunteer fire company or
14 volunteer ambulance company located within this Commonwealth
15 shall be reimbursed for LEGAL expenses incurred with respect to <--
16 services performed BY SAID COMPANIES at or in connection with <--
17 facilities on premises owned or leased by the Commonwealth.
18 Section 3. The Department of Justice shall provide, without
19 cost to such volunteer companies, legal counsel for the purpose
20 of defending any legal action arising out of or in connection
1 with any services performed on behalf of the Commonwealth by
2 such companies with respect to such facilities or premises.
3 Section 4. In any case where a conflict of interest prevents
4 the Department of Justice from providing legal counsel as
5 provided in section 3 of this act, the Commonwealth shall
6 reimburse the volunteer fire company or volunteer ambulance
7 company for the cost incurred by the company in defending such
8 legal action, LEGAL FEES BEING SUBJECT TO APPROVAL BY THE COURT <--
9 WHEREIN THE ACTION IS FILED, except that this act shall not be
10 construed to:
11 (1) make the Commonwealth liable for any judgment or
12 liability resulting in such action by virtue of such service; or
13 (2) create a right of reimbursement from the Commonwealth to
14 such volunteer companies with respect to such liability or
15 judgment.
16 Section 5. The sum of $100,000 or as much thereof as may be
17 necessary is hereby appropriated to the Department of Property
18 and Supplies to carry out the performance of this act.
19 Section 6. This act shall take effect immediately, provided
20 that the provisions of sections 3 and 4 shall apply to legal
21 services arising from services rendered prior to the effective
22 date of this act.
