AS AMENDED ON THIRD CONSIDERATION, IN SENATE, JUNE 22, 1976
AN ACT 1 Making an appropriation to the Department of Commerce for the 2 Pennsylvania Industrial Development Authority. 3 The General Assembly of the Commonwealth of Pennsylvania 4 hereby enacts as follows: 5 Section 1. The sum of $10,000,000, or as much thereof as may 6 be necessary, is hereby specifically appropriated to the 7 Department of Commerce for the Pennsylvania Industrial 8 Development Authority for the purposes set forth in the act of 9 May 17, 1956 (P.L.1609, No.537), known as the "Pennsylvania 10 Industrial Development Authority Act." 11 Section 2. None of the above appropriation shall be used in 12 connection with any facility in Pennsylvania for the manufacture 13 or assembly of motor vehicles by a foreign-based manufacturer 14 except under the following conditions: 15 (1) The foreign manufacturer shall use a Pennsylvania port
1 for the distribution point for all assembled motor vehicles, 2 accessory parts and tools. 3 (2) All assembly parts, tools and special machinery 4 transported from a foreign port via ocean to the Commonwealth 5 from the foreign-based manufacturer shall use a Pennsylvania 6 port as a receiving point. Provided, That the above conditions <-- 7 are contingent upon the Pennsylvania port's ocean freight rates 8 being competitive. 9 (3) PROVIDED THAT THE ABOVE CONDITIONS ARE CONTINGENT UPON <-- 10 THE TOTAL TRANSPORTATION COSTS, AVAILABILITY OF FACILITIES, 11 FREQUENCY OF SHIPMENTS, AND CONDITIONS OF DELIVERY OF 12 PENNSYLVANIA'S PORTS BEING COMPETITIVE, AND PROVIDING FURTHER 13 THAT THESE CONDITIONS DO NOT APPLY TO ANY SUCH ITEMS TRANSPORTED 14 PURSUANT TO AGREEMENTS IN EFFECT ON THE EFFECTIVE DATE OF THIS 15 ACT. 16 Section 3. Any moneys of this appropriation which are 17 uncommitted, unencumbered or unexpended on June 30, 1977 shall 18 lapse. 19 Section 4. This act shall take effect July 1, 1976.
