                                     AN ACT

     1  Amending the act of May 11, 1905 (P.L.518, No.429), entitled "An
     2     act making an appropriation for the erection of a home or
     3     school for indigent orphans, to be called the Thaddeus
     4     Stevens Industrial and Reform School of Pennsylvania, in
     5     which school provision shall be made for giving instruction
     6     in reading, writing, arithmetic, drawing, duties of
     7     citizenship, elementary manual training, the elements of
     8     farming, and other requisite branches," changing the name of
     9     the school, further providing for administration, admissions,
    10     tuition students, ex-officio visitors and the annual report,
    11     providing for a president, and other administrative personnel
    12     and rights of teachers, eliminating salary provisions and
    13     making editorial corrections.

    14     The General Assembly of the Commonwealth of Pennsylvania
    15  hereby enacts as follows:
    16     Section 1.  The title, act of May 11, 1905 (P.L.518, No.429),
    17  entitled "An act making an appropriation for the erection of a
    18  home or school for indigent orphans, to be called the Thaddeus
    19  Stevens Industrial and Reform School of Pennsylvania, in which
    20  school provision shall be made for giving instruction in
    21  reading, writing, arithmetic, drawing, duties of citizenship,
    22  elementary manual training, the elements of farming, and other
    23  requisite branches," is amended to read:


     1                               AN ACT
     2  Making an appropriation for the erection of a home or school for
     3     indigent orphans, to be called the Thaddeus Stevens
     4     [Industrial and Reform School of Pennsylvania,] State School
     5     of Technology in which school provision shall be made for
     6     giving instruction in reading, writing, arithmetic, drawing,
     7     duties of citizenship, elementary manual training, the
     8     elements of farming, and other requisite branches.
     9     Section 2.  Section 1 of the act, amended April 29, 1909
    10  (P.L.274, No.176), is amended to read:
    11     Section 1.  Be it enacted, &c., That within ninety days of
    12  the passage of this act, the governor shall appoint five
    13  commissioners, who shall serve without compensation, who shall
    14  build an institution on such plot of ground, not less than two
    15  acres, as the citizens of Lancaster, Pennsylvania, may donate
    16  for the purpose aforesaid, for the education and training of
    17  indigent orphans: Provided, however, If a sufficient number of
    18  the above class to fill the places provided in said school, who
    19  are deemed by the trustees, under rules established for the
    20  government of the school, qualified for admission, shall not
    21  apply, then the board of trustees of the corporation created by
    22  this act may admit, first, (i) [orphans who may not be indigent]
    23  other deserving persons, and, afterwards, (ii) [other deserving
    24  boys, though they be not orphans,] orphans who may not be
    25  indigent as the trustees in their best judgment may think
    26  proper.  Those shall be deemed orphans who have lost either
    27  parent.
    28     Section 3.  Section 5 of the act is amended to read:
    29     Section 5.  The buildings shall be separated, and shall
    30  embrace one or more school houses, and one or more workshops,

     1  and an isolating hospital, all on such scale as will create an
     2  institution accommodating not less than two hundred [boys]
     3  persons, planned and located for easy and natural additions, as
     4  the needs of the institution may demand.
     5     Section 4.  Section 7 of the act, amended June 21, 1947
     6  (P.L.764, No.327), is amended to read:
     7     Section 7.  The said commissioners, upon the completion of
     8  the said institution, shall surrender their trust to a board of
     9  trustees to consist of nine members, who shall serve without
    10  compensation, and be appointed by the Governor, by and with the
    11  advice and consent of the Senate.  Said trustees shall be a body
    12  politic or corporate, of the name of the Thaddeus Stevens [Trade
    13  School] State School of Technology.  They shall manage and
    14  direct the affairs of the institution, and make all necessary
    15  by-laws and regulations, not inconsistent with either the
    16  provisions of the Constitution, [or] laws of the Commonwealth,
    17  or rules and regulations of the State Board of Education. Of the
    18  trustees first appointed, three shall serve for one year, three
    19  for two years, and three for three years, and at the expiration
    20  of the respective periods the vacancies shall be filled by the
    21  Governor, by appointment, for three years, as hereinbefore
    22  provided; and should any vacancy occur by death or resignation,
    23  or otherwise, of any trustee, such vacancy shall be filled, by
    24  appointment as aforesaid, for the unexpired term of said
    25  trustee.  The [Superintendent of Public Instruction] Secretary
    26  of Education shall be ex-officio member of the board of
    27  trustees.
    28     Section 5.  The act is amended by adding a section to read:
    29     Section 7.1.  The chief administrator and academic officer of
    30  the Thaddeus Stevens State School of Technology shall be the

     1  president whose duties shall be defined by the Board of Trustees
     2  and approved by the Secretary of Education. Other administrative
     3  personnel shall be designated at the discretion of the Board of
     4  Trustees.
     5     Section 6.  Sections 8 and 8.1 of the act, amended or added
     6  January 14, 1952 (P.L.1927, No.532), are amended to read:
     7     Section 8.  There shall be received into the institution
     8  indigent orphan [boys] persons or other deserving [boys]
     9  persons, from the State of Pennsylvania, above the age of
    10  fifteen years, whose admission may be applied for under such
    11  regulations as the Board of Trustees may adopt. In considering
    12  such admission no preference shall be shown on account of race,
    13  [or] color, [or] sex, marital status, sexual preference, ethnic
    14  group or religion. The course of instruction shall be the
    15  equivalent level of the junior and senior year of a four year
    16  public vocational-technical high school [course and] and/or a
    17  two year postsecondary institution which shall include (1)
    18  vocational education of [less than college grade] no more than
    19  two years leading to the awarding of diplomas, certificates or
    20  associate degrees, when approved by the Secretary of Education
    21  in accordance with rules and regulations established by the
    22  State Board for this level of education, for the purpose of
    23  fitting students to pursue effectively a recognized profitable
    24  employment, and (2) evening or other classes providing such
    25  instruction for persons [seventeen years of age or over] who
    26  have left full-time school providing the Board of Trustees shall
    27  establish and charge tuition for such instruction that will
    28  cover the total cost of instruction including all direct costs
    29  and the allocable portion of all applicable indirect costs.
    30     Section 8.1.  In addition to State-supported resident

     1  students as defined in section 1, the board of trustees may
     2  admit for study at the school part-time or full-time
     3  [nonresident] tuition students, and shall fix and charge tuition
     4  rates as approved by the Secretary of Education for such
     5  [nonresident] students. All money collected as tuition by the
     6  institution shall be paid into the General Fund and credited to
     7  the appropriations made to the institution.
     8     Section 7.  Section 10 of the act is amended to read:
     9     [Section 10.  The salaries of the officers, teachers and
    10  attendants of the institution shall be fixed by the Board of
    11  Trustees.]
    12     Section 8.  The act is amended by adding a section to read:
    13     Section 10.1.  Except as otherwise provided by law, teachers
    14  in the Thaddeus Stevens State School of Technology shall enjoy
    15  the same privileges, including tenure rights, and be subject to
    16  the same laws as teachers in the public schools of this
    17  Commonwealth.
    18     Section 9.  Section 11 of the act is amended to read:
    19     Section 11.  The Governor, [Superintendent of Public
    20  Instruction] Secretary of Education, Judges of the several
    21  courts of the State, and Senators and Representatives in the
    22  Legislature shall be ex-officio visitors of said institution;
    23  and it shall be subject to inspection by the Department of
    24  [Public Instruction] Education; and an annual report of the
    25  conduct and management of the school shall be made by the
    26  [Superintendent of Public Instruction] President to the General
    27  Assembly and the Secretary of Education.
    28     Section 10.  Whenever in any law reference is made to the
    29  Thaddeus Stevens Industrial and Reform School of Pennsylvania or
    30  the Thaddeus Stevens Trade School it shall be deemed to refer to

     1  and include the Thaddeus Stevens State School of Technology.
     2     Section 11.  This act shall take effect immediately.
