AN ACT
1 Providing for the establishment of the Commonwealth Productivity
2 Council; prescribing its powers and duties and making an
3 appropriation.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Short Title.--This act shall be known and may be
7 cited as the "Commonwealth Productivity Council Act."
8 Section 2. Declaration of Purpose.--It is the intention of
9 the General Assembly to provide means for improving the quality
10 and quantity of governmental services rendered to the citizens
11 of this Commonwealth. Such improvements in productivity are
12 especially necessary in regard to:
13 (i) the use of innovative techniques in the utilization of
14 capital and labor;
15 (ii) the use of modern technology in service utilization; and
16 (iii) the use of modern management techniques of systems
17 analysis, planning and evaluation.
18 In order to provide expertise for the research and
1 investigation necessary to such an endeavor, it is appropriate
2 that a Commonwealth Productivity Council be established to study
3 and make recommendations to the Governor and to the General
4 Assembly on methods, approaches, and alternatives to improve
5 governmental productivity and to oversee the activities of the
6 executive branch in these areas.
7 Section 3. Commonwealth Productivity Council.--There is
8 hereby established an independent advisory council to be known
9 as the Commonwealth Productivity Council, which shall consist of
10 16 members. The members of the council shall be: the Secretary
11 of Administration, who shall serve as chairman of the council;
12 the Secretary of Commerce; the Secretary of Labor and Industry;
13 the Secretary of Budget; the Governor's Science Advisor; four
14 members appointed by the Governor; one of whom shall be a
15 representative of business management; one of whom shall be a
16 representative of Pennsylvania's labor organizations; one of
17 whom shall be a Commonwealth employee; and one of whom shall be
18 a representative of the consuming public; three members
19 appointed by the Speaker of the House of Representatives; at
20 least two of whom shall be members of the House, providing
21 representation of both political parties; three members
22 appointed by the President pro tempore of the Senate; at least
23 two of whom shall be members of the Senate, providing
24 representation of both political parties; and one member
25 designated by the Local Government Conference as its
26 representative. Members of the council shall be encouraged to
27 make available their staff to assist the council in the conduct
28 of its activities.
29 Section 4. Powers and Duties of Council.--The council shall
30 have the power and its duty shall be to:

1 (1) Examine the Commonwealth's procedures and systems for
2 effectiveness and efficiency measurement and make
3 recommendations to improve such activities so as to complement
4 productivity improvements mentioned below.
5 (2) Examine the feasibility of applying productivity
6 incentive pay systems to the State Government and consider other
7 productivity improvements in the realm of labor-management
8 relations.
9 (3) Examine methods and approaches to improve worker
10 satisfaction in State Government through recognition,
11 participation, rotation, and other performance incentives.
12 (4) Examine ways to apply improved management and systems
13 approaches to the operations of State Government to increase
14 productivity.
15 (5) Examine existing State systems for monitoring and
16 performance assessment of service delivery to increase
17 productivity.
18 (6) Examine the feasibility of creating a "productivity
19 bank" for the State Capital Budget.
20 (7) Examine State tax policies, financial incentives,
21 program requirements, and planning and administrative systems
22 now being utilized and make recommendations for changes so as to
23 increase outputs of service and administrative operations.
24 (8) Examine and propose better methods for the State to
25 carry out its productivity improvement program including
26 measurements, output classifications, etc.
27 (9) Examine the State's procurement practices to determine
28 where the Commonwealth could best apply and support new
29 technological applications to increase productivity.
30 (10) Examine and make recommendations for changes in State

1 civil service laws that retard productivity improvements.
2 (11) Make recommendations for components of an overall
3 Commonwealth productivity policy.
4 (12) Suggest a model law for productivity bargaining in the
5 governmental sector.
6 (13) Examine any other areas of interest pertaining to the
7 improvement of State and local government productivity.
8 Section 5. Staff and Activities of Council.--The council
9 shall carry out its duties and responsibilities through the
10 hiring of professional staff and assistance, including
11 consultants, and may hold conferences, conduct seminars,
12 formulate model programs, furnish assistance, and carry out any
13 other activities relating to the council's duties and
14 responsibilities delineated in section 4.
15 Section 6. Reports.--The council may issue interim reports
16 including a plan of action for increasing the productivity of
17 the government in the Commonwealth.
18 Section 7. Program Review and Information to General
19 Assembly.--The council shall, among its other duties, review and
20 advise the General Assembly on the effectiveness and success of
21 the Governor's productivity improvement program and shall
22 conduct an ongoing quality control and verification process
23 either directly or by contract of the Governor's productivity
24 improvement program.
25 Section 8. Appropriation.--The sum of $100,000 is
26 specifically appropriated to the Commonwealth Productivity
27 Council to carry out the purposes of this act.
28 Section 9. Effective Date.--This act shall take effect
29 immediately.
