                                     AN ACT

     1  Amending the act of May 20, 1949 (P.L.1633, No.493), entitled,
     2     as amended, "An act providing and regulating State assistance
     3     for housing and redevelopment, including comprehensive
     4     programs for the development of entire sections or
     5     neighborhoods; and making an appropriation," further
     6     providing for grant authorizations.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 4, act of May 20, 1949 (P.L.1633,
    10  No.493), known as the "Housing and Redevelopment Assistance
    11  Law," reenacted and amended April 12, 1956 (P.L.1449, No.477),
    12  and December 16, 1968 (P.L.1219, No.385), is amended to read:
    13     Section 4.  Grant Authorization.--The department is hereby
    14  authorized, within the limitations hereinafter provided, (a) to
    15  make capital grants in the furtherance of housing development
    16  and to assist the construction and operating of housing projects
    17  through the payment of such grants by contracting with
    18  governmental agencies or authorities such as housing authorities
    19  and urban redevelopment authorities, or with limited dividend
    20  housing corporations, insurance companies, or any other private,


     1  public or semi-public agencies, firms or corporations providing
     2  adequate surety, acceptable to the department, guaranteeing
     3  continuity of operation throughout the term of its contract, and
     4  (b) to make capital grants to redevelopment authorities in the
     5  furtherance of redevelopment, and (c) to make capital grants to
     6  municipalities or to redevelopment authorities for the
     7  prevention and elimination of blight, and (d) to make capital
     8  grants to governmental agencies or authorities or nonprofit
     9  corporations for the purpose of providing funds, which would be
    10  otherwise unavailable to initiate, apply for, administer, and
    11  execute lower income housing projects financed under any
    12  [Federal] State or local lower income housing program, said
    13  housing projects to be built and operated in accordance with
    14  [Federal] applicable State or local law and regulations,
    15  including income limitations, and said housing projects shall
    16  not be bound by the conditions attached to housing projects
    17  pursuant to [section 4] clause (a), and said grant shall not
    18  exceed ten per cent of the total cost of a proposed project, and
    19  (e) to make capital grants to governmental agencies or
    20  authorities, or nonprofit corporations for the purpose of
    21  acquiring [single family] dwelling units which are in a state of
    22  disrepair, and to rehabilitate said dwelling units and to sell
    23  these dwelling units to persons or families whose income is not
    24  higher than the [highest annual income level in the lower or
    25  middle third of nonfarm family incomes, and whose financial
    26  resources would be insufficient to purchase said dwelling unit
    27  after rehabilitation without the assistance provided by this
    28  act, purchaser's income to be considered insufficient in cases
    29  where more than twenty per cent of said income would be required
    30  for debt service to liquidate the mortgage; the resale price for

     1  the rehabilitated dwelling unit shall not be less than the cost
     2  of initial acquisition, nor more than the cost of acquisition
     3  and rehabilitation;] limits set by applicable State or local
     4  housing programs for lower income families; programs under this
     5  [subsection 4] clause (e) shall not be bound by the conditions
     6  attached to housing projects produced under [subsection 4]
     7  clauses (a), and (f) to cooperate with and make exchanges of the
     8  use of personnel, or funds with other departments, agencies, or
     9  instrumentalities of the Commonwealth in the execution of
    10  housing functions delegated to said departments, agencies, or
    11  instrumentalities by the General Assembly.
    12     There shall be no discrimination against any person because
    13  of race, color, religion or national origin in the rental or
    14  occupancy of any housing constructed under the provisions of
    15  this act.
    16     Section 2.  This act shall take effect immediately.
