                                     AN ACT

     1  Amending the act of April 29, 1959 (P.L.58, No.32), entitled "An
     2     act consolidating and revising the Vehicle Code, the Tractor
     3     Code, the Motor Vehicle Financial Responsibility Act and
     4     other acts relating to the ownership, possession and use of
     5     vehicles and tractors," prohibiting the publication or sale
     6     of certain records and providing penalties.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Section 619.2, act of April 29, 1959 (P.L.58,
    10  No.32), known as "The Vehicle Code," added January 24, 1966
    11  (1965 P.L.1497, No.527), is amended by adding a subsection to
    12  read:

     1     Section 619.2.  Compilation of Statistics.--* * *
     2     (e)  Notwithstanding any other provision of law to the
     3  contrary, it shall be unlawful for any employe of the Department
     4  of Transportation, or any employe of any department or agency
     5  which receives or reviews statistics compiled under this
     6  section, to sell, publish or disclose or offer to sell, publish
     7  or disclose any statistics compiled under the provisions of this
     8  act. It shall be unlawful for any individual to purchase, secure
     9  or procure or offer to purchase, secure, or procure any
    10  statistics compiled under the provisions of this act.
    11     Any individual violating the provisions of this subsection
    12  shall be guilty of a misdemeanor and sentenced to pay a fine of
    13  two thousand five hundred dollars ( $2,500) or serve a term in
    14  prison of one (1) year or both.
    15     The provisions of this subsection shall not apply to any
    16  court ordered release, to any criminal investigation by a grand
    17  jury or district attorney or to a police officer in the
    18  performance of his lawful duties provided said police officer
    19  furnishes a written authorization from the head of the police
    20  force for such records.
    21     Section 2.  This act shall take effect in 30 days.
