AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," removing the medical 21 doctors from the State Board of Osteopathic Examiners and 22 making editorial changes. 23 The General Assembly of the Commonwealth of Pennsylvania 24 hereby enacts as follows: 25 Section 1. Section 416, act of April 9, 1929 P.L.177, 26 No.175), known as "The Administrative Code of 1929," amended 27 February 2, 1956 (P.L.992, No.310), is amended to read:
1 Section 416. State Board of Osteopathic Examiners.--The 2 State Board of Osteopathic Examiners shall consist of the 3 [Superintendent of Public Instruction] Commissioner of 4 Professional and Occupational Affairs and [seven] five members, 5 [five of whom] who shall be graduates of a legally incorporated 6 and reputable college of osteopathy, and shall have been 7 licensed to practice osteopathy under the laws of this 8 Commonwealth, and shall not be in any manner financially 9 interested in or connected with the faculty or management of any 10 osteopathic school or college, and shall have been engaged in 11 the practice of osteopathy in this Commonwealth for a period of 12 at least five years. [The remaining two members shall be doctors 13 of medicine licensed to practice medicine and surgery in this 14 Commonwealth, for a period of not less than five years 15 immediately prior to their appointment.] 16 The osteopathic members of the board, qualified as aforesaid, 17 shall be appointed from a full list of the members in good 18 standing of the Pennsylvania Osteopathic Association, which list 19 shall be furnished to the Governor by the president and 20 secretary of such association annually. In the case of the 21 failure of the Pennsylvania Osteopathic Association to submit 22 such a list to the Governor, the Governor shall appoint members 23 in good standing of such association without restriction. 24 [The medical members of the board, qualified as aforesaid, 25 shall be appointed from a full list of the members in good 26 standing of the Medical Society of the State of Pennsylvania, 27 which list shall be furnished to the Governor by the president 28 and secretary of such society annually. In the case of the 29 failure of the Medical Society of the State of Pennsylvania to 30 submit such a list to the Governor, the Governor shall appoint 19750H1973B2532 - 2 -
1 members in good standing of such society without restriction.] 2 The terms of the members of the board shall be four years 3 from the respective dates of their appointment. 4 [Five] Three members of the board shall constitute a quorum, 5 and the board shall annually select, from among its number, a 6 chairman, and shall elect a secretary who need not be a member 7 of the board. 8 The members of the board, other than the [Superintendent of 9 Public Instruction] Commissioner of Professional and 10 Occupational Affairs, shall receive fifteen dollars per diem, 11 when actually engaged in the performance of their official 12 duties, and the secretary shall receive such reasonable 13 compensation as the board shall determine, with the approval of 14 the [Superintendent of Public Instruction] Commissioner of 15 Professional and Occupational Affairs. 16 Section 2.
