                                     AN ACT

     1  Amending the act of December 6, 1972 (P.L.1464, No.333),
     2     entitled "An act relating to the care, guidance, control,
     3     trial, placement and commitment of delinquent and deprived
     4     children," requiring notification to parents or guardians of
     5     children who are being prosecuted in a summary offense or in
     6     a civil matter before a justice of the peace or a magistrate.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of December 6, 1972 (P.L.1464, No.333),
    10  known as the "Juvenile Act," is amended by adding a section to
    11  read:
    12     Section 9.1.  Notification Required.--Whenever any child is
    13  the defendant in a summary proceeding or in a civil case before
    14  a justice of the peace or a magistrate, the prosecuting party or
    15  the plaintiff shall notify the parents or legal guardian of the
    16  child of the proceeding or case before the justice of the peace
    17  or the magistrate by mailing a copy of the notice of the hearing
    18  to the parents or guardian by registered mail, return receipt
    19  requested, addressee only. If any prosecuting party or plaintiff
    20  fails to so notify the parents or guardian of the child, the

     1  justice of the peace or the magistrate shall dismiss the charge
     2  or the complaint with prejudice.
     3     Section 2.  This act shall take effect in 60 days.
