AN ACT 1 Authorizing the Department of Property and Supplies, with the 2 approval of the Department of Agriculture and the Governor, 3 to convey to the City of Harrisburg, two tracts of land 4 situate in Susquehanna Township, Dauphin County, 5 Pennsylvania. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The Department of Property and Supplies, with the 9 approval of the Department of Agriculture and the Governor, is 10 hereby authorized, on behalf of the Commonwealth of 11 Pennsylvania, to grant and convey to the City of Harrisburg, the 12 following tracts of land situate in the Township of Susquehanna, 13 County of Dauphin, and Commonwealth of Pennsylvania, bounded and 14 described as follows: 15 Parcel 1. 16 Beginning at a point in the centre of Hospital Road 25 feet 17 south of the north side of Maclay Street at property of the 18 Pennsylvania State Lunatic Hospital; thence northwardly along 19 the property of the said Pennsylvania State Lunatic Hospital 150
1 feet; thence westwardly along the property of said hospital 200 2 feet to the Pennsylvania Canal; thence northwardly along the 3 said canal 670 feet to property now or late of Robert's estate; 4 thence eastwardly by said property 100 feet to the centre of 5 Paxton Creek; thence down through the centre of said Paxton 6 Creek by its several courses to the centre of Hospital Road 25 7 feet south of the north side of Maclay Street and thence 8 westwardly through the centre of said Hospital Road 205 feet to 9 the place of beginning, containing 4.07 acres. 10 Parcel 2. 11 Beginning at a stake on Maclay Street, the "division" line 12 between the city of Harrisburg and Susquehanna Township 13 aforesaid, where said street intersects the Pennsylvania Canal 14 on the eastern side of said canal; thence along the line of the 15 property of the said Pennsylvania Canal Company, northerly a 16 distance of 150 feet to a stake; thence on a line parallel with 17 said Maclay Street easterly, a distance of 200 feet to a stake; 18 thence on a line parallel with the first mentioned line, coming 19 along the line of the property of the said Pennsylvania Canal 20 Company, southerly a distance of 150 feet, to a stake on Maclay 21 Street; thence westerly along the line of said Maclay Street, a 22 distance of 200 feet, to a stake the place of beginning. 23 Section 2. The conveyance shall be made under and subject to 24 all easements, servitudes and rights of others, including but 25 not confined to streets, roadways, and rights of any telephone, 26 telegraph, water, electric, sewer, gas or pipeline companies, as 27 well as under and subject to any interest, estates, or tenancies 28 vested in third persons, whether or not appearing of record, for 29 any portion of the land or improvements erected thereon. 30 Section 3. The deed of conveyance shall contain a clause 19750H1322B1537 - 2 -
1 that the lands conveyed shall be used for municipal purposes by 2 the City of Harrisburg and if at any time the City of Harrisburg 3 or its successor in function conveys said property or authorizes 4 or permits said property to be used for any purpose other than 5 municipal purposes, the title thereto shall immediately revert 6 to and revest in the Commonwealth of Pennsylvania. 7 Section 4. The deed of conveyance shall be approved by the 8 Department of Justice and shall be executed by the Secretary of 9 Property and Supplies in the name of the Commonwealth of 10 Pennsylvania. 11 Section 5.
