AS AMENDED ON THIRD CONSIDERATION, IN SENATE, JUNE 28, 1976
AN ACT
1 Providing for the approval or disapproval of applications for a
2 permit relating to the construction or maintenance of
3 improvements to real estate.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. A municipality which regulates the construction,
7 erection, maintenance, operation or repair of buildings,
8 structures or devices by means of an ordinance requiring the
9 filing of an application, the payment of a fee and the issuance
10 of a permit shall render a decision either approving or
11 disapproving the application for a permit within 60 90 days <--
12 after the application is filed unless the ordinance requires a
13 decision within a lesser period of time, provided that any
14 disapproval of the application shall be issued within said 60- <--
15 day period containing an attached explanation clearly stating
16 all 90-DAY PERIOD CONTAINING A BRIEF EXPLANATION SETTING FORTH <--
17 the reasons for said disapproval and the manner in which the
18 application can be corrected and/or modified to obtain the
1 required approval. If no decision is rendered on the application
2 within 60 90 days, the application shall be deemed to be <--
3 approved and the permit shall be DEEMED TO HAVE BEEN granted <--
4 immediately, unless the applicant has agreed in writing to an
5 extension of time. No agreement to extension of time for action
6 may be made a part of an application form nor may any such
7 agreement be required of any applicant under threat of denial of
8 the application.
9 As used in this section, "buildings, structures or devices"
10 means anything constructed or erected with a fixed location on
11 or in the ground including dwellings, offices, places of
12 assembly, mobile homes, signs, walls, fences, or other
13 improvements to real estate.
14 Section 2. This act shall take effect immediately.
