                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising consolidating and
     4     changing the laws relating thereto," further providing for
     5     the salaries of district attorneys and providing for a full-
     6     time district attorney.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The heading of section 1401, act of July 28, 1953
    10  (P.L.723, No.230), known as the "Second Class County Code," is
    11  amended and a subsection is added to read:
    12     Section 1401.  District Attorney; Qualifications;
    13  Eligibility; Compensation.--* * *
    14     (d)  The compensation of the district attorney shall be one
    15  thousand dollars ($1000) lower than the compensation paid to a
    16  judge of the court of common pleas in the judicial district in
    17  counties of the second class and second class A. The
    18  compensation to be paid to the district attorney shall be
    19  divided equally between the county and the Commonwealth in order


     1  to accomplish the purpose of this section. The district attorney
     2  shall devote full time to the office, and shall not be permitted
     3  any private practice during the period in which the individual
     4  serves in the aforesaid office.
     5     Section 2.  (a) Section 5 of the act of November 1, 1971
     6  (P.L.495, No.113), entitled "An act providing for the
     7  compensation of county officers in counties of the second
     8  through eighth classes, for the disposition of fees, for filing
     9  of bonds in certain cases and for duties of certain officers,"
    10  is repealed in so far as it relates to district attorneys in
    11  counties of the second class and in counties of the second class
    12  A.
    13     (b)  Any other act or part of an act inconsistent with the
    14  provisions of this act are repealed to the extent of the
    15  inconsistency.
    16     Section 3.  This act shall take effect immediately and apply
    17  to all district attorneys whose term of office begins January 1,
    18  1976.
