                                     AN ACT

     1  Amending the act of April 29, 1959 (P.L.58, No.32), entitled "An
     2     act consolidating and revising the Vehicle Code, the Tractor
     3     Code, the Motor Vehicle Financial Responsibility Act and
     4     other acts relating to the ownership, possession and use of
     5     vehicles and tractors," requiring school buses to be equipped
     6     with safety belts or safety harness assemblies and requiring
     7     their use when school buses are in motion.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Subsection (b) of section 840, act of April 29,
    11  1959 (P.L.58, No.32), known as "The Vehicle Code," is amended by
    12  adding a clause to read:
    13     Section 840.  School Buses; Safety Requirements.--

    15     (b)  No person shall own or operate a school bus carrying
    16  school children on the highways of this Commonwealth that, in
    17  addition to the other requirements of this act, does not conform
    18  with the following:

    20     (15)  Each school bus shall, in addition to any other
    21  equipment required by this act, be equipped with one (1)

     1  approved safety belt or safety harness assembly for use with
     2  each seat on the bus, and the operator shall instruct the school
     3  children to use such belt or assembly whenever the bus is in
     4  motion.
     5     Penalty.--Any person violating any of the provisions of this
     6  section, or standards or regulations promulgated hereunder
     7  shall, upon summary conviction before a magistrate, be sentenced
     8  to pay a fine of not less than ten dollars ($10.00) and not more
     9  than twenty-five dollars ($25.00) and costs of prosecution, and,
    10  in default of the payment thereof, shall undergo imprisonment
    11  for not less than five (5) days and not more than ten (10) days.
    12     Section 2.  This act shall take effect immediately.
