                                     AN ACT

     1  Amending the act of January 22, 1968 (P.L.42, No.8), entitled
     2     "An act empowering and authorizing the Department of
     3     Community Affairs to establish and administer certain grant
     4     programs for the betterment of mass transportation systems
     5     and facilities throughout the Commonwealth; providing for
     6     State grants to transportation companies, municipalities,
     7     counties, or their instrumentalities and to agencies and
     8     instrumentalities of the Commonwealth for studies, research,
     9     demonstration programs, promotion programs, purchase of
    10     service projects, and capital improvement projects under
    11     certain conditions; authorizing grants by counties or
    12     municipalities in metropolitan areas to local transportation
    13     organizations," further providing for free local transit
    14     service for persons age sixty-five or older.

    15     The General Assembly of the Commonwealth of Pennsylvania
    16  hereby enacts as follows:
    17     Section 1.  Clause (5) of section 4, act of January 22, 1968
    18  (P.L.42, No.8), known as the "Pennsylvania Urban Mass
    19  Transportation Assistance Law of 1967," added December 27, 1972
    20  (P.L.1631, No.339), is amended to read:
    21     Section 4.  Program Authorizations.--The department is hereby
    22  authorized, within the limitations hereinafter provided:
    23     * * *
    24     (5)  To make grants to agencies and instrumentalities of the

     1  Commonwealth and to municipalities, counties, or their
     2  instrumentalities from the State Lottery Fund to pay [estimated]
     3  transit losses resulting from granting free service to persons
     4  sixty-five years of age or older on common carrier mass
     5  transportation systems when such passage is by local public bus,
     6  trolley or subway-elevated systems during nonpeak riding hours
     7  and on holidays and weekends. "Transit losses" as used in this
     8  section shall mean the exact amount in dollars and cents equal
     9  to the total of all actually counted individual fares granted
    10  free to persons sixty-five years of age or older on such common
    11  carrier mass transportation systems as herein provided. The
    12  department shall promulgate such rules and regulations as are
    13  necessary to carry out the purposes of this clause.
    14     In counties where there does not now exist a mass
    15  transportation authority the department shall enter into
    16  agreements with private carriers, authorized to carry passengers
    17  for hire by the Public Utilities Commission to carry out the
    18  purposes of this clause.
    19     Section 2.  This act shall take effect in 30 days.
