AN ACT
1 Amending the act of April 29, 1959 (P.L.58, No.32), entitled "An
2 act consolidating and revising the Vehicle Code, the Tractor
3 Code, the Motor Vehicle Financial Responsibility Act and
4 other acts relating to the ownership, possession and use of
5 vehicles and tractors," further defining "highway."
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. The definition of "Highway" in section 102, act
9 of April 29, 1959 (P.L.58, No.32), known as "The Vehicle Code,"
10 amended December 21, 1973 (No.149), is amended to read:
11 Section 102. Definitions.--The following words and phrases
12 when used in this act shall, for the purpose of this act, have
13 the following meanings, respectively, except in those instances
14 where the context clearly indicates a different meaning:

16 "Highway."--Every way or place, of whatever nature, open to
17 the use of the public as a matter of right, for purposes of
18 vehicular travel. To facilitate enforcement of this act by
19 Security or Campus Police, appointed under authority of section
1 2416 of the act of April 9, 1929 (P.L.177, No.175), known as
2 "The Administrative Code of 1929," the term "highway" shall be
3 deemed to include a roadway or driveway upon grounds owned by
4 all State colleges and universities and State-aided or related
5 colleges and universities, private colleges and universities and
6 community colleges, so long as their aforementioned roadways or
7 driveways remain open to the use of the public, for purposes of
8 vehicular travel. The term "highway" shall also be deemed to
9 include a roadway or driveway upon grounds owned by school
10 districts. The term "highway" shall not be deemed to include a
11 roadway or driveway upon grounds owned by private persons or
12 institutions other than colleges [and] universities and public
13 schools.
