                                     AN ACT

     1  Amending the act of July 28, 1953 (P.L.723, No.230), entitled,
     2     as amended, "An act relating to counties of the second class
     3     and second class A; amending, revising, consolidating and
     4     changing the laws relating thereto," providing for a fulltime
     5     district attorney in second class A counties, establishing
     6     his salary and providing for the appointment of fulltime
     7     assistant district attorneys in such counties.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  Section 1401, act of July 28, 1953 (P.L.723,
    11  No.230), known as the "Second Class County Code," is amended by
    12  adding subsections to read:
    13     Section 1401.  District Attorney; Qualifications;
    14  Eligibility.--* * *
    15     (d)  The district attorney in second class A counties shall
    16  devote all of his time to the performance of his duties as the
    17  district attorney and shall not practice before the courts of
    18  the Commonwealth in any other capacity.
    19     (e)  The annual salary of the district attorney in a second
    20  class A county shall be forty thousand dollars ($40,000)


     1  notwithstanding the provisions of any other law to the contrary.
     2     Section 2.  Section 1420 of the act is amended to read:
     3     Section 1420.  Assistant District Attorneys; Number;
     4  Compensation.--(a) The district attorney may appoint such number
     5  of part-time assistants in second class A counties and such
     6  number of assistants in second class counties, learned in the
     7  law, to assist him in the discharge of his duties, the number
     8  and salary of such assistants to be fixed by the salary board.
     9     (b)  The district attorney in second class A counties may
    10  appoint such number of assistants, who shall be learned in the
    11  law and who shall devote all of their time to the performance of
    12  their duties as assistant district attorneys, to assist him in
    13  the discharge of his duties. The number and salary of such
    14  fulltime assistants shall be determined by the district attorney
    15  subject to approval of the Salary Board and the Board of
    16  Commissioners.
