                                     AN ACT

     1  Amending the act of December 2, 1968 (P.L.1144, No.358),
     2     entitled "An act to provide for the office of public
     3     defender, authorizing assistance and other personnel, and to
     4     provide adequate representation for persons who have been
     5     charged with an indictable offense or with being a juvenile
     6     delinquent, who for lack of sufficient funds are unable to
     7     obtain legal counsel," further providing for the
     8     qualifications of public defenders and assistant public
     9     defenders in counties of the second class.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  Subsection (a) of section 5, act of December 2,
    13  1968 (P.L.1144, No.358), known as the "Public Defender Act," is
    14  amended to read:
    15     Section 5.  Personnel of Office; Compensation;
    16  Qualification.--(a) The public defender, with the approval of
    17  the appointive body, may provide for as many full or part time
    18  assistant public defenders, clerks, investigators, stenographers
    19  and other employes as he may deem necessary to enable him to
    20  carry out the duties of his office: Provided, however, That in
    21  counties of the second class the public defender and all

     1  assistant public defenders shall not engage in the practice of
     2  law except as employes of the Office of the Public Defender and
     3  shall be full time employes of the office. The salary board
     4  shall fix the salary of the public defender and of the personnel
     5  authorized by this section.
