AN ACT 1 Amending the act of June 24, 1931 (P.L.1206, No.331), entitled 2 "An act concerning townships of the first class; amending, 3 revising, consolidating, and changing the law relating 4 thereto," authorizing certain fire companies, rescue 5 companies and ambulance companies to purchase petroleum 6 products, materials, supplies and equipment relating to motor 7 vehicles, by way of purchase contracts therefor by the 8 township. 9 The General Assembly of the Commonwealth of Pennsylvania 10 hereby enacts as follows: 11 Section 1. Section 1502, act of June 24, 1931 (P.L.1206, 12 No.331), known as "The First Class Township Code," reenacted and 13 amended May 27, 1949 (P.L.1955, No.569), is amended by adding a 14 clause to read: 15 Section 1502. The corporate power of a township of the first 16 class shall be vested in the board of township commissioners. 17 The board shall have power-- 18 * * * 19 LXVIII. Participation in Certain Purchase Contracts.--To 20 permit, subject to such terms and conditions as they may, and as 21 hereinafter specifically provided, shall prescribe, any
1 nonprofit fire company, nonprofit rescue company and nonprofit 2 ambulance company in the township to participate in purchase 3 contracts for petroleum products, materials, supplies and 4 equipment relating to motor vehicles entered into by the 5 township. Any such company in the township desiring to 6 participate in such purchase contracts shall file with the 7 commissioners a request that it be authorized to participate in 8 contracts for the purchase of petroleum products, materials, 9 supplies and equipment relating to motor vehicles of the 10 township and agreeing that it will be bound by such terms and 11 conditions as the township may, and as hereinafter specifically 12 provided, shall, prescribe and that it will be responsible for 13 payment directly to the vendor under each purchase contract. 14 Among such terms and conditions, the township shall prescribe 15 that all prices shall be F.O.B. destination.
