AN ACT
1 Amending the act of August 9, 1963 (P.L.628, No.337), entitled
2 "An act relating to charitable organizations; requiring the
3 registration of such organizations; and regulating the
4 solicitation of money and property by or on behalf of
5 charitable organizations," exempting certain nonprofit
6 library associations from the act.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Clause (7) of subsection (a) of section 4, act of
10 August 9, 1963 (P.L.628, No.337), known as the "Solicitation of
11 Charitable Funds Act," amended December 10, 1974 (No.297), is
12 amended to read:
13 Section 4. Certain Persons and Organizations Exempt from
14 Registration.--(a) The following charitable organizations shall
15 not be required to file an annual registration statement with
16 the department:

18 [(7) Libraries which meet the following criteria:
19 (i) The library shall be a public library;
1 (ii) The library shall neither engage nor utilize the
2 services of a professional fund raiser;
3 (iii) The library shall file an annual report with the State
4 Library System; and
5 (iv) The funds received by the library shall not exceed
6 fifty thousand dollars ($50,000) in any one year.]
7 (7) Nonprofit PUBLIC NONPROFIT library organizations which <--
8 receive financial aid from municipal and State governments AND <--
9 FILE AN ANNUAL FISCAL REPORT WITH THE STATE LIBRARY SYSTEM AND
10 THE COMMISSION ON CHARITABLE ORGANIZATIONS.
