A SUPPLEMENT 1 To the act of May 28, 1937 (P.L.955, No.265), entitled, as 2 amended, "An act to promote public health, safety, morals, 3 and welfare by declaring the necessity of creating public 4 bodies, corporate and politic, to be known as housing 5 authorities to engage in slum clearance, and to undertake 6 projects, to provide dwelling accommodations for persons of 7 low income; providing for the organization of such housing 8 authorities; defining their powers and duties; providing for 9 the exercise of such powers, including the acquisition of 10 property by purchase, gift or eminent domain, the renting and 11 selling of property, and including borrowing money, issuing 12 bonds, and other obligations, and giving security therefor; 13 prescribing the remedies of obligees of housing authorities; 14 authorizing housing authorities to enter into agreements, 15 including agreements with the United States, the 16 Commonwealth, and political subdivisions and municipalities 17 thereof; defining the application of zoning, sanitary, and 18 building laws and regulations to projects built or maintained 19 by such housing authorities; exempting the property and 20 securities of such housing authorities from taxation; and 21 imposing duties and conferring powers upon the State Planning 22 Board, and certain other State officers and departments," 23 providing for civil service protection for certain employees 24 of certain housing authorities. 25 The General Assembly of the Commonwealth of Pennsylvania 26 hereby enacts as follows: 27 Section 1. Housing authorities existing under the provisions 28 of the act to which this is a supplement, located in any city of
1 the second class A or third class or in a county second class A <--
2 OF THE THIRD to eighth class, shall within 12 months following <--
3 the effective date of this act, enter into a contract with the
4 Pennsylvania Civil Service Commission for the purpose of
5 establishing a complete civil service merit system protecting
6 the employees of the authority. The contract shall be executed
7 in accordance with the provisions of the act of August 5, 1941
8 (P.L.752, No.286), known as the "Civil Service Act," and each
9 authority is authorized to make the payments required by that
10 act.
11 Section 2. (a) The contract shall provide for a civil
12 service merit system for all management employees including
13 administrative nontechnical employees who are not subject to
14 collective bargaining agreements under the act of July 23, 1970
15 (P.L.563, No.195), known as the "Public Employe Relations Act,"
16 of the housing authority except members thereof. The civil
17 service commission shall use only the provisions of the "Civil
18 Service Act" in setting standards and principles for employment
19 with the authority. The commission shall include in the system
20 the same duties and obligations, rights, prerogatives, and
21 appeals provided for employees by the "Civil Service Act."
22 (b) The agreement shall provide that persons employed on the
23 effective date of this act shall continue in their present
24 positions, without taking an examination, and may be removed
25 only in accordance with section 807 of the "Civil Service Act."
26 (c) The agreement shall also provide that the compensation
27 of all authority employees shall be determined by the authority
28 in accordance with uniform schedules adopted by the authority
29 using the classifications established by the civil service
30 commission as a basis for such determination. In no event shall

1 the compensation of any person employed by an authority on the 2 effective date of this act be reduced through an action of the 3 civil service commission or the authority during the period he 4 holds the same position he held on that day. 5 Section 3. During the period following the effective date of 6 this act until the execution of the contract, employees shall 7 enjoy civil service protection and may be removed only in 8 accordance with the "Civil Service Act." Housing authorities 9 hereafter created shall be subject to this act and shall enter 10 into the required contract within 12 months of the date of 11 organization. A27L6ML/19750H0295B0742 - 3 -
