AN ACT 1 Amending the act of June 1, 1959 (P.L.350, No.77), entitled "An 2 act relating to the retirement of public school employes; 3 amending, revising, consolidating and changing the laws 4 relating thereto," providing for post-retirement supplements. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Section 407, act of June 1, 1959 (P.L.350, 8 No.77), known as the "Public School Employes' Retirement Code of 9 1959," is amended by adding a subsection to read: 10 Section 407. Minimum and Supplemental Benefits to Former 11 School Employes.-- 12 * * * 13 (8) Every annuitant who is in receipt of a superannuation, 14 withdrawal or disability allowance which became effective on or 15 prior to July 1, 1975, shall receive a cost-of-living supplement 16 determined as a percentage applied to the entire retirement 17 annuity as of June 30, 1976. Any annuitant whose effective date 18 of retirement is after July 1, 1975 and prior to March 1, 1976
1 shall receive a supplement determined as an adjustment of five 2 percent (5%) applied to the entire retirement annuity on the 3 effective date of retirement. All supplements provided in this 4 subsection shall be payable beginning July 1, 1976 under the 5 same terms and conditions as provided under the option plan in 6 effect as of June 30, 1976: 7 (a) The cost-of-living supplements herein provided have been 8 calculated as a constant proportion of percentage increases in 9 the Consumer Price Index (U.S. average all items) prepared and 10 published by the U.S. Department of Labor, Bureau of Labor 11 Statistics. Each percentage factor is equal to two-thirds of the 12 percentage change in said index from January 1967 or June of the 13 fiscal year of retirement, whichever is later, to June 1976. The 14 applicable percentage factors are: 15 Effective date of retirement Percentage factor 16 After July 1, 1974 through July 1, 1975 7% 17 After July 1, 1973 through July 1, 1974 12% 18 After July 1, 1972 through July 1, 1973 14% 19 After July 1, 1971 through July 1, 1972 18% 20 After July 1, 1970 through July 1, 1971 23% 21 After July 1, 1969 through July 1, 1970 28% 22 After July 1, 1968 through July 1, 1969 31% 23 On or prior to July 1, 1968 33% 24 (b) The cost-of-living supplement as determined in clause 25 (a) of this subsection shall not be payable to an annuitant 26 receiving a withdrawal annuity prior to the first day of July 27 coincident with or following his attainment of superannuation 28 age. 29 (c) Any disability annuitant whose effective date of 30 retirement is prior to July 1, 1973 and whose annuity was 19750H0281B0304 - 2 -
1 increased by less than twenty percent (20%) of the annuity at 2 the time of retirement under the amendatory act of November 27, 3 1970 (P.L.798, No.261) or September 9, 1971 (P.L.456, No.106), 4 shall receive beginning July 1, 1976, an additional increase in 5 his annuity equal to twenty percent (20%) of the annuity at the 6 time of retirement less the increase he received under either 7 amendatory act. 8 (d) No supplement effective after the death of the member 9 shall be payable to the beneficiary or survivor annuitant of 10 such deceased former school employee. 11 Section 2.
