                                     AN ACT

     1  Amending the act of April 29, 1959 (P.L.58, No.32), entitled,
     2     "An act consolidating and revising the Vehicle Code, the
     3     Tractor Code, the Motor Vehicle Financial Responsibility Act
     4     and other acts relating to the ownership, possession and use
     5     of vehicles and tractors," directing the issuance of special
     6     registration plates EXEMPT FROM ALL REGISTRATION FEES to       <--
     7     CERTAIN disabled veterans; exempting motor vehicles bearing    <--
     8     such plates from certain parking restrictions for limited
     9     times; and prescribing penalties.

    10     The General Assembly of the Commonwealth of Pennsylvania
    11  hereby enacts as follows:
    12     Section 1.  The act of April 29, 1959 (P.L.58, No.32), known
    13  as "The Vehicle Code," is amended by adding a section to read:
    14     Section 501.3.  Special Plates for Disabled Veterans.--On the
    15  application of any ONE HUNDRED (100) PERCENT TOTALLY disabled     <--
    16  veteran WHOSE DISABILITY IS SERVICE CONNECTED AND WHO IS so       <--
    17  certified by the United States Veterans' Administration, the
    18  department shall issue to him special registration plates
    19  designating the vehicle so licensed as belonging to a disabled
    20  veteran. The registration plates shall have a white background,

     1  shall have blue numbers or letters as the department may
     2  determine, and shall have the words, "disabled veteran," in at
     3  least ten-point bold type, inscribed in red at the bottom of the
     4  plate. The department shall issue registration plates so
     5  designated only to persons who are disabled veterans AS SET       <--
     6  FORTH IN THIS SECTION. The department shall not charge any fee,   <--
     7  other than the regular fee for annual registration, for the
     8  issuance of such registration plates. THE DEPARTMENT SHALL        <--
     9  EXEMPT FROM ALL REGISTRATION FEES ANY VETERAN WHO IS SO           <--
    10  CERTIFIED. BY THE VETERANS ADMINISTRATION AS BEING ONE HUNDRED    <--
    11  (100) PERCENT DISABLED. THE PROVISIONS OF THIS SECTION SHALL
    12  APPLY TO ONLY ONE VEHICLE, WEIGHING NOT MORE THAN NINE THOUSAND   <--
    13  (9,000) POUNDS, OWNED AND USED BY SUCH VETERAN OR BY SUCH
    14  VETERAN AND HIS SPOUSE.
    15     Penalty.--Any person who is not a disabled veteran, as
    16  prescribed in this section and who wilfully and falsely
    17  represents himself as having the qualifications to obtain such
    18  vehicle registration plates in an attempt to procure the special
    19  plates prescribed by this section, shall, upon summary
    20  conviction before a magistrate, be sentenced to pay a fine of
    21  fifty dollars ($50.00) and costs of prosecution, and in default
    22  of the payment thereof, shall undergo imprisonment for not more
    23  than ten (10) days.
    24     Section 2.  Clause (15) of section 1021 of the act, amended
    25  November 10, 1965 (P.L.839, No.353) is amended to read:
    26     Section 1021.  Parking Prohibited in Specified Places.--No
    27  person shall park a vehicle or tractor, or permit it to stand,
    28  whether attended or unattended, upon a highway or in any of the
    29  following places:

     1     (15)  Except for disabled vehicles on a medial or dividing
     2  strip or plot separating divided highways, which disabled
     3  vehicles may remain there for a period of thirty six (36) hours,
     4  after which said vehicle shall be deemed to have been abandoned
     5  and peace officers shall have authority to remove it and place
     6  it in storage.
     7     A further exception shall be made when a person operating a
     8  motor vehicle bearing plates issued to a handicapped person as
     9  prescribed in section 501.1 of this act or to a disabled veteran
    10  as prescribed in section 501.3 of this act and which motor
    11  vehicle is being operated by or for the benefit of such
    12  handicapped person or disabled veteran shall be relieved of any
    13  liability with respect to parking for a period of ninety minutes
    14  in excess of the legal parking period permitted by local
    15  authorities except where local ordinances or police regulations
    16  prohibit parking on any highway for the purpose of creating a
    17  fire lane or where said ordinances or police regulations provide
    18  for the accommodation of heavy traffic during morning, afternoon
    19  or evening hours or where such motor vehicle is parked in such a
    20  manner as to clearly be a traffic hazard.
    21     Penalty.--Any person violating any of the provisions of this
    22  section shall, upon summary conviction before a magistrate, be
    23  sentenced to pay a fine of not less than two dollars ($2.00) nor
    24  more than ten dollars ($10.00) and costs of prosecution, and, in
    25  default of the payment thereof, shall undergo imprisonment for
    26  not more than five (5) days.
