AN ACT
1 Amending the act of July 4, 2008 (P.L., No.41), entitled "An act
2 providing for the capital budget for the fiscal year 2007-
3 2008; itemizing public improvement projects, furniture and
4 equipment projects, transportation assistance projects,
5 redevelopment assistance capital projects, flood control
6 projects, Keystone Recreation, Park and Conservation Fund
7 projects, Environmental Stewardship Fund projects, Motor
8 License Fund projects, State forestry bridge projects,
9 Pennsylvania Fish and Boat Commission projects, Manufacturing
10 Fund projects, State ATV/Snowmobile Fund projects, State
11 transportation enhancement funds projects and federally
12 funded projects to be constructed or acquired or assisted by
13 the Department of General Services, the Department of
14 Community and Economic Development, the Department of
15 Conservation and Natural Resources, the Department of
16 Environmental Protection, the Pennsylvania Fish and Boat
17 Commission and the Department of Transportation, together
18 with their estimated financial costs; authorizing the
19 incurring of debt without the approval of the electors for
20 the purpose of financing the projects to be constructed,
21 acquired or assisted by the Department of General Services,
22 the Department of Community and Economic Development, the
23 Department of Conservation and Natural Resources, the
24 Department of Environmental Protection, the Pennsylvania Fish
25 and Boat Commission or the Department of Transportation;
26 stating the estimated useful life of the projects; providing
27 an exemption; providing for limitation on certain capital
28 projects, for special provisions for certain redevelopment
29 assistance capital projects and for preemption of local
30 ordinances for Department of Corrections projects; making
31 appropriations; and making a repeal," providing for special
32 provisions for the Youth Study Center in Philadelphia.
33 The General Assembly of the Commonwealth of Pennsylvania
1 hereby enacts as follows:
2 Section 1. The act of July 4, 2008 (P.L., No.41), known as
3 the Capital Budget Project Itemization Act of 2007-2008, is
4 amended by adding a section to read:
5 Section 23.1. Special provisions relating to Youth Study
6 Center.
7 Notwithstanding any other provision of law to the contrary,
8 the following apply to the project itemized in section
9 6(51)(ii)(J7):
10 (1) Subject to paragraph (2), section 318 of the act of
11 February 9, 1999 (P.L.1, No.1), known as the Capital
12 Facilities Debt Enabling Act, provides the exclusive bidding
13 requirements for the project.
14 (2) A bidder on the project must agree to participate in
15 the Philadelphia Area Labor Management Committee's BUILT-RITE
16 Construction Industry Program.
17 Section 2. This act shall take effect immediately.
