AN ACT
1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in pupils and attendance, further
6providing for cost of tuition and maintenance of certain
7exceptional children in approved institutions.
8The General Assembly of the Commonwealth of Pennsylvania
9hereby enacts as follows:
10Section 1. Section 1376 of the act of March 10, 1949
11(P.L.30, No.14), known as the Public School Code of 1949, is
12amended by adding a subsection to read:
13Section 1376. Cost of Tuition and Maintenance of Certain
14Exceptional Children in Approved Institutions.--* * *
15(c.9) The following shall apply:
16(1) Beginning in fiscal year 2014-2015, in a fiscal year
17when there is no increase in the State allocation to approved
18private schools under subsection (a.2), an amount equal to the
19funds remitted to the Commonwealth by the approved private
20schools under subsection (c.2)(5)(ii) from the previous fiscal
1year that may not exceed two million five hundred thousand
2dollars ($2,500,000) is appropriated to the Department of
3Education for the purpose of making payments to the approved
4private schools for pupils who are enrolled with the approval of
5funding by the Department of Education.
6(2) The funds available for payment under paragraph (1)
7shall be distributed as follows:
8(i) Divide the amount of funding paid to the approved
9private school during the previous year under subsection (a.2)
10by the total allocation of funding paid to approved private
11schools under subsection (a.2) during the previous year.
12(ii) Multiply the quotient under subparagraph (i) by the
13amount of funding available for payment under paragraph (1).
14(3) Funds distributed under this subsection shall be paid in
15twelve (12) equal monthly payments.

17Section 2. This act shall take effect June 30, 2014, or
18immediately, whichever is later.
