AN ACT
Amending Title 62 (Procurement) of the Pennsylvania Consolidated
Statutes, in contracts for public works, providing for
specifications for contracts.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Title 62 of the Pennsylvania Consolidated
Statutes is amended by adding a section to read:
ยง 3914. Specifications for contracts.
(a) Specifications for contracts.--A specification for a
contract awarded under this chapter may not require:
(1) a successful bidder or subcontractor to utilize only
workers who are:
(i) represented by a designated labor organization;
or
(ii) referred by a designated labor organization;
(2) a successful bidder's work force or any of its
subcontractors' work forces to affiliate with or pay dues to
a labor organization; or

(3) a successful bidder or any of its subcontractors to
recognize a labor organization as the exclusive
representative of any of its employees on the project.
(b) Discrimination prohibited.--A government agency may not
consider or use as a criterion in its selection process whether
or not a bidder uses a unionized work force.
Section 2. This act shall take effect in 60 days.
