AN ACT

 

1Amending the act of June 3, 1937 (P.L.1333, No.320), entitled 
2"An act concerning elections, including general, municipal, 
3special and primary elections, the nomination of candidates, 
4primary and election expenses and election contests; creating 
5and defining membership of county boards of elections; 
6imposing duties upon the Secretary of the Commonwealth, 
7courts, county boards of elections, county commissioners; 
8imposing penalties for violation of the act, and codifying, 
9revising and consolidating the laws relating thereto; and 
10repealing certain acts and parts of acts relating to 
11elections," further providing for residual funds.

12The General Assembly of the Commonwealth of Pennsylvania
13hereby enacts as follows:

14Section 1. Section 1630 of the act of June 3, 1937
15(P.L.1333, No.320), known as the Pennsylvania Election Code,
16added October 4, 1978 (P.L.893, No.171), is amended to read:

17Section 1630. Residual Funds.--

18In the event that a candidate or political committee
19terminates its financial activity as such, then the disbursement
20of any residual funds remaining in such an account shall be made
21in the following manner:

22(1) any such funds may be used for any expenditure as

1defined by this article; [and]

2(2) may be returned, pro rata, to the contributors by the
3candidate or treasurer of the political committee. A final
4report must be made by the next January 31 in accordance with
5section 1627[.]; and

6(3) in the event the candidate was elected to a judicial
7office, the funds may be distributed to a nonprofit community
8organization that is registered with the Department of State
9under the act of December 19, 1990 (P.L.1200, No.202), known as
10the "Solicitation of Funds for Charitable Purposes Act."

11Section 2. This act shall take effect in 60 days.
