AN ACT
1Amending the act of August 9, 1955 (P.L.323, No.130), entitled,
2as amended, "An act relating to counties of the first, third,
3fourth, fifth, sixth, seventh and eighth classes; amending,
4revising, consolidating and changing the laws relating
5thereto; relating to imposition of excise taxes by counties,
6including authorizing imposition of an excise tax on the
7rental of motor vehicles by counties of the first class; and
8providing for regional renaissance initiatives," in
9prothonotary, clerks of court, clerk of orphan's court,
10register of wills and recorder of deeds, further providing
11for how offices to be held.
12The General Assembly of the Commonwealth of Pennsylvania
13hereby enacts as follows:
14Section 1. Section 1302 of the act of August 9, 1955
15(P.L.323, No.130), known as The County Code, is amended by
16adding a subsection to read:
17Section 1302. How Offices to Be Held.--* * *
18(a.4) Notwithstanding subsection (a) or (a.1), or any other
19law, the county commissioners of a county of the fourth class
20may adopt a resolution providing that the office of the
21prothonotary may be merged with the office of the clerk of
22courts, unless local law applying to such counties shall
23otherwise provide. If two persons hold the office of the
1prothonotary and the office of the clerk of courts at the time
2the resolution is adopted, the combining of the offices shall
3take effect in the year in which the offices are next up for
4election.
