| AN ACT |
| |
1 | Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An |
2 | act relating to the public school system, including certain |
3 | provisions applicable as well to private and parochial |
4 | schools; amending, revising, consolidating and changing the |
5 | laws relating thereto," further providing for State |
6 | appropriations for approved private schools and for chartered |
7 | schools for the deaf and blind. |
8 | The General Assembly of the Commonwealth of Pennsylvania |
9 | hereby enacts as follows: |
10 | Section 1. Sections 1376(a.2) and 1376.1(b.2) of the act of |
11 | March 10, 1949 (P.L.30, No.14), known as the Public School Code |
12 | of 1949, amended July 4, 2004 (P.L.536, No.70), are amended to |
13 | read: |
14 | Section 1376. Cost of Tuition and Maintenance of Certain |
15 | Exceptional Children in Approved Institutions.--* * * |
16 | (a.2) For the 2005-2006 school year and each school year |
17 | thereafter, the Department of Education shall determine the |
18 | payment amount for each approved private school for all students |
19 | enrolled in an approved private school for the prior school year |
20 | as follows: |

1 | (1) (i) Multiply the payment determined for the immediate |
2 | preceding school year by one hundred and twenty-five percent |
3 | (125%) of the percentage increase in the appropriation for |
4 | special education for the fiscal year prior to the fiscal year |
5 | in which payments under this subsection are made. |
6 | (ii) Add the product from subparagraph (i) to the payment |
7 | determined for the immediate preceding school year. |
8 | (iii) In any fiscal year in which there is no increase in |
9 | the State appropriation for special education, the increase for |
10 | the approved private schools in the following fiscal year(s) |
11 | shall be calculated by applying the multiplier in (a.2)(1)(i) to |
12 | the average of the percentage increase in the appropriation for |
13 | special education and the appropriation for basic education for |
14 | the last fiscal year in which there was an increase in the |
15 | special education and basic education State appropriations. |
16 | (2) No later than May 10, 2005, and no later than May 10 of |
17 | each year thereafter, the Department of Education shall notify |
18 | each school district of residence or charter school of a child |
19 | enrolled in an approved private school of its payment amount |
20 | under subsection (a). |
21 | (3) The Department of Education shall pay each approved |
22 | private school the total amount calculated pursuant to this |
23 | subsection divided into twelve (12) monthly payments. The |
24 | Department of Education shall withhold the school district or |
25 | charter school payment amount calculated under subsection (a) |
26 | from the amount of any and all State payments made to the school |
27 | district or charter school. In no event shall the sum of the |
28 | Commonwealth's share of payments to approved private schools |
29 | under this subsection exceed the appropriation for approved |
30 | private schools. |

2 | Section 1376.1. Actual Cost of Tuition and Maintenance of |
3 | Certain Exceptional Children in the Four Chartered Schools for |
4 | Education of the Deaf and the Blind.--* * * |
5 | (b.2) Payments are as follows: |
6 | (1) For the 2005-2006 school year and each school year |
7 | thereafter, the department shall determine the payment amount |
8 | for each chartered school for all students enrolled in a |
9 | chartered school for the prior school year as follows: |
10 | (i) Multiply the payment determined for the immediate |
11 | preceding school year by one hundred and twenty-five percent |
12 | (125%) of the percentage increase in the appropriation for |
13 | special education for the fiscal year prior to the fiscal year |
14 | in which payments under this subsection are made. |
15 | (ii) Add the product under subparagraph (i) to the payment |
16 | determined for the immediately preceding school year. |
17 | (iii) In any fiscal year in which there is no increase in |
18 | the State appropriation for special education, the increase for |
19 | the chartered schools for the deaf and blind in the following |
20 | fiscal year(s) shall be calculated by applying the multiplier in |
21 | (b.2)(1)(i) to the average of the percentage increase in the |
22 | appropriation for special education and the appropriation for |
23 | basic education for the last fiscal year in which there was an |
24 | increase in the special education and basic education funding |
25 | State appropriation. |
26 | (2) No later than May 10, 2005, and no later than May 10 of |
27 | each school year thereafter, the department shall notify each |
28 | school district of residence or charter school of a child |
29 | enrolled in a chartered school of its payment amount under |
30 | subsection (b). |

1 | (3) The department shall pay each chartered school the total |
2 | amount calculated pursuant to this subsection divided into |
3 | twelve (12) monthly payments. The department shall withhold the |
4 | school district or charter school payment amount calculated |
5 | under subsection (b) from the amount of any and all State |
6 | payments made to the school district or charter school. In no |
7 | event shall the sum of the Commonwealth's share of payments to |
8 | chartered schools under this subsection exceed the appropriation |
9 | for chartered schools. |
