                                     AN ACT

     1  Providing for certain disclosures by practitioners of the
     2     healing arts when making patient referrals.

     3     The General Assembly of the Commonwealth of Pennsylvania
     4  hereby enacts as follows:
     5  Section 1.  Definitions.
     6     The following words and phrases when used in this act shall
     7  have the meanings given to them in this section unless the
     8  context clearly indicates otherwise:
     9     "Practitioner of the healing arts."  Any person who engages
    10  in the diagnosis or treatment of disease or any ailment of the
    11  human body.
    12  Section 2.  Disclosure of interest in referral facilities.
    13     Any practitioner of the healing arts shall, prior to referral
    14  of a patient to any facility or entity engaged in providing
    15  health-related services, tests, pharmaceuticals, appliances or
    16  devices, disclose to the patient any financial interest of the
    17  practitioner or ownership by the practitioner in the facility or

     1  entity. In making any referral, the practitioner of the healing
     2  arts may render any recommendations he considers appropriate,
     3  but shall advise the patient of his freedom of choice in the
     4  selection of a facility or entity. Any person who violates the
     5  provisions of this section commits a misdemeanor of the third
     6  degree.
     7  Section 3.  Effective date.
     8     This act shall take effect in 60 days.
