AN ACT
1 Authorizing the release of Project 70 restrictions imposed on
2 certain land owned by Indiana County, being conveyed by the
3 county in return for the imposition of Project 70
4 restrictions on certain land being conveyed to the county by
5 the Department of Transportation.
6 The General Assembly of the Commonwealth of Pennsylvania
7 hereby enacts as follows:
8 Section 1. Indiana County.
9 (a) Authorization.--Pursuant to the requirements of section
10 20(b) of the act of June 22, 1964 (Sp.Sess., P.L.131, No.8),
11 known as the Project 70 Land Acquisition and Borrowing Act, the
12 General Assembly hereby authorizes the release of Project 70
13 restrictions on a portion of lands owned by Indiana County,
14 which are more particularly described in subsection (c), in
15 return for imposition of Project 70 restrictions on land to be
16 acquired by the Department of Transportation and deeded to FOR <--
17 Indiana County, as described in subsection (d). This release of
18 Project 70 restrictions is necessary due to the realignment of
1 State Route 22, Section 491, through Pine Ridge Park, Indiana 2 County. 3 (b) Freedom of restrictions.--The lands described in 4 subsection (c), owned by Indiana County and being conveyed to 5 the Department of Transportation, shall be free of restrictions 6 on use and alienation imposed by section 20 of the Project 70 7 Land Acquisition and Borrowing Act upon the imposition of and 8 recording of the Project 70 deed restriction set forth in 9 subsection (e) on the parcel of replacement land owned ACQUIRED <-- 10 by the Department of Transportation and being conveyed to FOR <-- 11 Indiana County. 12 (c) Lands to be released from restrictions.--The parcel of 13 land to be released from Project 70 restrictions is situate in 14 the Township of Burrell, Indiana County, and more particularly 15 described as follows: 16 All that certain piece or parcel of land, situated in Burrell 17 Township, County of Indiana, and State of Pennsylvania, bounded 18 and described as follows: 19 Beginning at a point on the northerly legal right of way line 20 of state Route 22, said point being a distance of 82.05 feet 21 measured at right angles at a northerly direction from the right 22 of way baseline of said state route at or about Station 23 167+55.00; thence in a easterly direction along said legal right 24 of way line of State Route 22 to a point, said point being a 25 distance of 81.94 feet measured at right angles at a northerly 26 direction from the right of way of baseline of said state route 27 at or about Station 176+47.18; thence in a northerly direction 28 along lands of Jamie R. Volchko and Eve T. Hudson to a point, 29 said point being a distance of 100 feet measured at right angles 30 at a northerly direction from the right of way baseline of said 20050S0600B1052 - 2 -
1 state route at or about Station 176+42.35; thence in a westerly 2 direction along proposed required right of way line of state 3 route and lands in which this is a part to a point, said point 4 being a distance of 100 feet measured at right angles at a 5 northerly direction from the right of way baseline of said state 6 route at or about Station 167+55.00; thence through lands in 7 which this is a part to the point of beginning. Containing 0.368 8 acres more or less. 9 (d) Land on which restrictions are to be imposed.--The 10 replacement parcel to be subject to the restrictions in exchange 11 for the parcel described in subsection (c) is located in the 12 Township of Burrell, Indiana County, and more particularly 13 described as follows: 14 All that certain piece or parcel of land, situated in Burrell 15 Township, County of Indiana, and State of Pennsylvania, bounded 16 and described as follows: 17 Beginning at a Parker Kalon Nail set in the centerline of 18 Township Road 724; thence along said Township Road South 29 19 degrees 47 minutes 10 seconds East 699.13 feet to a Parker Kalon 20 Nail; thence along lands of Daniel L. McGinity passing through a 21 Iron Pin 30.00 feet distance from said Nail North 55 degrees 15 22 minutes 00 seconds East 660.64 feet to a Iron Pin; thence along 23 lands of County of Indiana passing through a Iron Pin 889.40 24 feet distant from said Iron Pin North 75 degrees 30 minutes 00 25 seconds West 919.40 feet to the point of beginning. Containing 26 5.28 acres more or less. 27 Above described parcel being part of a larger parcel or tract 28 of land conveyed to Jane Geeting by deed recorded in the Indiana 29 County Recorder of Deeds of in Deed Book 1003, Page 193. 30 (e) Deed restriction.--The deed restriction to be 20050S0600B1052 - 3 -
1 transferred to the parcel described in subsection (d) shall read 2 as follows: 3 This indenture is given to provide land for recreation, 4 conservation and historical purposes, as said purposes are 5 defined in the Project 70 Land Acquisition and Borrowing Act, 6 approved June 22, 1964 (Sp.Sess., P.L.131). 7 Section 2.
