SENATE BILL

No. 399 Session of 2001

        REFERRED TO LOCAL GOVERNMENT, FEBRUARY 8, 2001

                                     AN ACT

     1  Amending the act of April 18, 1929 (P.L.612, No.253), entitled,
     2     as amended, "An act for the election of the mayor, members of
     3     town council, and auditors, in incorporated towns of the
     4     Commonwealth; regulating the manner of voting for such
     5     officers, and repealing inconsistent general, local and
     6     special laws," providing residency requirements for vacancy
     7     appointments.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  The act of April 18, 1929 (P.L.612. No.253),
    11  entitled, as amended, "An act for the election of the mayor,
    12  members of town council, and auditors, in incorporated towns of
    13  the Commonwealth; regulating the manner of voting for such
    14  officers, and repealing inconsistent general, local and special
    15  laws," is amended by adding a section to read:
    16     Section 2.1.  Notwithstanding any other provision of this
    17  act, all elected town officers shall reside in the town from
    18  which elected and shall have resided in the town continuously
    19  for at least one year immediately prior to election, and no
    20  person shall be appointed to fill a vacancy in an elected town

     1  office unless he or she has resided within the town continuously
     2  for at least one year immediately prior to his or her
     3  appointment.
     4     Section 2.  This act shall take effect in 60 days.
