                                     AN ACT

     1  Amending the act of August 24, 1963 (P.L.1132), entitled "An act
     2     providing for the creation, establishment and operation of
     3     community colleges, granting certain powers to the State
     4     Board of Education, the Council of Higher Education and the
     5     Department of Public Instruction; authorizing school
     6     districts, county boards of school directors and
     7     municipalities to sponsor community colleges; authorizing
     8     school districts and municipalities to levy certain taxes;
     9     providing for reimbursements by the Commonwealth of certain
    10     costs and expenses, and making an appropriation," further
    11     providing for the tuition charge of community colleges.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 9, act of August 24, 1963 (P.L.1132),
    15  known as the "Community College Act of 1963," is amended to
    16  read:
    17     Section 9.  Tuition.--(a)  The normal tuition charged by each
    18  community college shall be an amount fixed by the board of
    19  trustees of the community college, in accordance with policies,
    20  standards, rules and regulations of the State Board of
    21  Education, determined by apportioning among the students
    22  enrolled in such college not more than one-third of its annual

     1  operating costs.
     2     (b)  A student who is not a resident in the area of the local
     3  sponsor of the community college in which he is enrolled and who
     4  enrolled himself in such college with the approval of the board
     5  of trustees of the community college established in the area in
     6  which he resides, if there be one, shall pay the normal tuition
     7  charge of the college he attends, but the board of trustees of
     8  the college established in his area of residence shall pay on
     9  behalf of such student to the college in which he is enrolled an
    10  amount equal to [twice such college's normal tuition charge and]
    11  the amount established by the board of trustees of the attended
    12  college as its own sponsor share of the cost per equivalent
    13  full-time student. The community college at which the student
    14  registers shall be entitled to State reimbursement on behalf of
    15  that student in the same manner as a student resident in the
    16  sponsorship area as hereinafter provided.
    17     (c)  A student who is a resident of the Commonwealth in an
    18  area which is not a local sponsor of a community college and who
    19  is enrolled in a community college in accordance with the
    20  policies, standards, rules and regulations of the State Board of
    21  Education shall pay a tuition charge [equal to twice such
    22  college's normal tuition charge.] fixed by the board of trustees
    23  of the college attended. Such tuition shall total the amount
    24  representing the difference between total operating cost per
    25  equivalent full-time student and the amount payable by the State
    26  on behalf of each equivalent full-time student enrolled. The
    27  community college enrolling such student shall be entitled to
    28  State reimbursement as hereinafter provided.
    29     (d)  A student who is not a resident in the area of the local
    30  sponsor of the community college in which he is enrolled and who

     1  has enrolled himself in such college without the approval of the
     2  board of trustees of the community college established in the
     3  area in which he resides, if there is one, shall pay a tuition
     4  charge [which shall be equal to three times the normal tuition    <--
     5  charge of the community college in which he is enrolled and no
     6  State reimbursement shall be paid on account of such student.]    <--
     7  fixed by the board of trustees of the college attended. Such
     8  tuition charge shall equal the difference between total
     9  operating cost per equivalent full-time student and the amount
    10  payable by the State on behalf of each equivalent full-time
    11  student enrolled. The community college enrolling such student
    12  shall be entitled to State reimbursement as hereinafter
    13  provided.
    14     (e)  A student who is not a resident of the Commonwealth and
    15  who is enrolled in a community college in accordance with the
    16  policies, standards, rules and regulations of the State Board of
    17  Education shall pay such tuition charge as is [approved by the    <--
    18  Department of [Public Instruction] fixed by the board of          <--
    19  trustees of that college for non-Commonwealth residents. With
    20  the approval of the board of trustees of the admitting community
    21  college and the Department of Education, students who are not
    22  residents of the Commonwealth may be eligible for whatever
    23  tuition credits are established through reciprocal agreements
    24  with other states EDUCATION.                                      <--
    25     Section 2.  This act shall take effect immediately.
