AN ACT
1 Authorizing the release of Project 70 restrictions imposed on
2 certain land owned by the Department of General Services,
3 Commonwealth of Pennsylvania, being conveyed by the
4 Commonwealth in return for the imposition of Project 70
5 restrictions on certain land being conveyed to the
6 Commonwealth by Skippack Township, Montgomery County.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. Department of General of Services.
10 (a) Authorization.--Pursuant to the requirements of section
11 20(b) of the act of June 22, 1964 (Sp.Sess., P.L.131, No.8),
12 known as the Project 70 Land Acquisition and Borrowing Act, the
13 General Assembly hereby authorizes the release of Project 70
14 restrictions on a portion of lands owned by the Commonwealth of
15 Pennsylvania and administered by the Department of General
16 Services which are more particularly described in subsection
17 (c), in return for the imposition of Project 70 restrictions on
18 land to be acquired by the Commonwealth of Pennsylvania from
19 Skippack Township, Montgomery County, as described in subsection
1 (c). This release of Project 70 restrictions is necessary due to
2 the realignment of and removing safety hazards associated with
3 State Route 0073 (Skippack Pike) and State Route 1006 (Evansburg
4 Road), Section 491, through Skippack Township, Montgomery
5 County.
6 (b) Freedom of restrictions.--The Department of General
7 Services is authorized to convey a portion of its Evansburg
8 State Park being one-half acre, more or less, as described in
9 subsection (c), lying adjacent to the right-of-way of Evansburg
10 Road and Old Forty Foot Road of Skippack Township from the
11 Commonwealth of Pennsylvania to Skippack Township free of
12 restrictions on use and alienation imposed by section 20 of the
13 Project 70 Land Acquisition and Borrowing Act upon the
14 imposition of and recording of the Project 70 deed restriction
15 set forth in subsection (f) on the parcel of replacement land
16 acquired by the Commonwealth of Pennsylvania from Skippack
17 Township, Montgomery County.
18 (c) Description of premise to be conveyed.--The parcel of
19 land to be released from Project 70 restrictions is situate in
20 the Skippack Township, Montgomery County, and more particularly
21 described as follows:
22 All that certain piece or parcel of land, situated in
23 Skippack Township, County of Montgomery and Commonwealth of
24 Pennsylvania, bounded and described as follows:
25 BEGINNING AT A POINT west of the corner of Skippack Pike (SR
26 0073) and Old Forty Foot Road (SR 1006) as shown on the plan
27 prepared by Traffic Planning and Design, Inc., Pottstown,
28 Pennsylvania dated October 25, 2006 said point being 16.49 feet
29 right of station 47+90.00,

29 (f) Land use restriction.--All conveyances authorized or
30 referred to under this act shall be made under and subject to

3 used as the location for a licensed gaming entity authorized
4 under 4 Pa.C.S. Part II (relating to gaming) or similar type of

6 condition shall be a convenant running with the land and shall
7 be binding upon the grantee, its successors and assigns. Should
8 any grantee, its successors or assigns, permit the property
9 conveyed in this act, or any portion thereof, to be used in
10 violation of this subsection, the title shall immediately revert
11 to and revest in the grantor.
12 (g) Execution.--The deed of conveyance from the Department
13 of General Services to Skippack Township shall be executed by
14 the Secretary of General Services in the name of the
15 Commonwealth and shall be approved for legality and form by the
16 authorized agency attorney of the Department of General Services
17 and the Office of Attorney General. Costs and fees incidental to
18 the conveyance shall be borne by the township.
19 (h) Deed restriction.--The deed restriction to be
20 transferred to the parcel described in subsection (d) shall read
21 as follows:
22 This indenture is given to provide land for recreation,
23 conservation and historical purposes, as said purposes
24 are defined in the act of June 22, 1964 (Sp.Sess.,
25 P.L.131, No.8), known as the Project 70 Land Acquisition
26 and Borrowing Act.
27 Section 2. Effective date.
28 This act shall take effect immediately.
