AN ACT 1 Amending Titles 53 (Municipalities Generally) and 62 2 (Procurement) of the Pennsylvania Consolidated Statutes, 3 prohibiting residency requirements in government contracts. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Title 53 of the Pennsylvania Consolidated 7 Statutes is amended by adding a section to read: 8 § 2316. Residency requirements in contracts. 9 (a) Prohibition.-- 10 (1) A local government may not require, by ordinance, 11 resolution or contractual condition, that work under a 12 contract be performed by individuals who are residents of the 13 local government. 14 (2) A city of the first class may not require, by 15 ordinance, resolution or contractual condition, that work 16 under a contract be performed by individuals who are 17 residents of the city. 18 (b) Effect.--A contractual provision in violation of
1 subsection (a) is void. 2 Section 2. Title 62 is amended by adding a section to read: 3 § 520.1. Residency requirements. 4 (a) Prohibition.--Except as provided in section 107 5 (relating to reciprocal limitations), a purchasing agency may 6 not require, by contractual condition, that work under the 7 contract be performed by residents of this Commonwealth. 8 (b) Effect.--A contractual provision in violation of 9 subsection (a) is void. 10 Section 3. Any ordinance or resolution in violation of 53 11 Pa.C.S. § 2316 is void. 12 Section 4. All acts and parts of acts are repealed insofar 13 as they are inconsistent with this act. 14 Section 5. The addition of 53 Pa.C.S. § 2316 and 62 Pa.C.S. 15 § 520.1 shall apply to contracts entered into or renewed on or 16 after the effective date of this act. 17 Section 6.
