AN ACT
1 Adding a certain portion of the Bayfront Parkway in the City of
2 Erie, Erie County, to the State Highway System, and
3 transferring to the City of Erie a certain State road.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Transfer of roads.
7 (a) Authorization.--
8 (1) Upon approval by resolution of the city council of
9 the transfer of State Route 4018 to the City of Erie as
10 provided in paragraph (2) and publication of the notice
11 required in subsection (c), that portion of Bayfront Parkway,
12 in the City of Erie, Erie County, beginning at the existing
13 Lincoln Avenue heading in an easterly direction to Sixth
14 Street, for a distance of 21,124 feet or 4.00 miles, is
15 hereby adopted as a State highway, to be known as State Route
16 290.
17 (2) That State Route 4018, in the City of Erie, Erie <--
18 County, for a distance of 31,283 feet or 5.925 miles, is
1 hereby transferred to the City of Erie, subject to approval
2 by resolution of the city council. The city council shall,
3 within 14 days of the adoption of such resolution, transmit
4 notice thereof to the Department of Transportation.
5 (b) Release of liability.--Upon publication of the notice
6 required in subsection (c):
7 (1) The City of Erie, Erie County, is hereby relieved of
8 all responsibility for maintenance of that portion of
9 Bayfront Parkway as described in subsection (a)(1).
10 (2) The Commonwealth is hereby relieved of all
11 responsibility for maintenance of the State Route 4018 as <--
12 described in subsection (a)(2).
13 (c) Publication.--The Department of Transportation shall
14 publish notice of approval of the transfer by the city council
15 as provided in subsection (a)(2) to the Legislative Reference
16 Bureau as a notice in the Pennsylvania Bulletin. The publication
17 shall occur within 30 days of the notice of approval to the
18 department.
19 Section 2. Effective date.
20 This act shall take effect in 60 days.
