| AN ACT |
| |
1 | Amending Title 3 (Agriculture) of the Pennsylvania Consolidated |
2 | Statutes, providing for nutrition labeling of fast foods. |
3 | The General Assembly of the Commonwealth of Pennsylvania |
4 | hereby enacts as follows: |
5 | Section 1. Title 3 of the Pennsylvania Consolidated Statutes |
6 | is amended by adding a section to read: |
7 | § 8102. Fast food labeling. |
8 | (a) Nutrition information on package.--Fast food sold within |
9 | this Commonwealth shall bear a nutrition label on the package or |
10 | container containing the following information in easy-to-read |
11 | type style: |
12 | (1) Serving size. |
13 | (2) Servings per container. |
14 | (3) Total calories. |
15 | (4) Calories from fat. |
16 | (5) Saturated fat. |
17 | (6) Total carbohydrates. |
18 | (7) Number of milligrams of sodium per serving. |

1 | (8) Cholesterol content per serving. |
2 | (9) Number of total dietary fiber grams per serving. |
3 | (10) Number of grams of protein per serving. |
4 | (b) Nutrition information on menu.--Fast food chain |
5 | restaurants with 15 or more national locations and $1,000,000 in |
6 | annual sales collectively for the chain shall display calorie, |
7 | saturated fat, sodium and carbohydrate information for foods and |
8 | beverages on menus. Other approved methods of display may |
9 | include, at the point of ordering, menu inserts, menu |
10 | appendices, supplemental menus or electronic kiosks at each |
11 | table, as long as the menu prominently states on each page the |
12 | location and means by which nutrition information is provided. |
13 | If the restaurant uses a menu board, calories must be posted on |
14 | the board or other approved, easily readable sign adjacent to |
15 | the menu board and visible from the line prior to the point of |
16 | ordering. The remaining nutrition information for saturated fat, |
17 | sodium and carbohydrates must be provided in a plainly visible |
18 | format at the point of ordering. Exemptions are provided for |
19 | items on the menu for less than 90 days: unopened, prepackaged |
20 | foods; food in salad bars, buffet lines, cafeteria service and |
21 | other self-serve arrangements; and food served by weight or |
22 | custom-ordered quantity. This section shall not apply to grocery |
23 | and convenience stores. |
24 | (c) Definition.--As used in this section, the term "fast |
25 | food" means food sold at a public eating place that is not |
26 | prepared to order and is typically received promptly after an |
27 | order for it is placed. |
28 | Section 2. This act shall take effect in 60 days. |
