                                     AN ACT

     1  Making an appropriation from the Motor License Fund for non-
     2     State-highway damage occurring during, or as a result of, the
     3     blizzard of 1996 and the resulting flood emergency.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  The sum of $41,000,000, or as much thereof as may
     7  be necessary, is hereby appropriated from the Motor License Fund
     8  to the Department of Transportation to provide a State
     9  contribution as part of the non-Federal share for county and
    10  municipal highways and roads damaged or destroyed by the
    11  blizzard of 1996 or the resulting flood emergency for which
    12  Federal participation is provided pursuant to The Robert T.
    13  Stafford Disaster Relief and Emergency Assistance Act (Public
    14  Law 93-288, 88 Stat. 143).
    15     Section 2.  The required non-Federal contribution necessary
    16  to secure Federal funding pursuant to The Robert T. Stafford
    17  Disaster Relief and Emergency Assistance Act (Public Law 93-288,
    18  88 Stat. 143) shall be divided between the Commonwealth and the

     1  affected political subdivision. The Commonwealth share shall be
     2  22% and the political subdivision share shall be 3%.
     3     Section 3.  The Commonwealth may reduce the share of an
     4  affected political subdivision if the tax base of that political
     5  subdivision was substantially reduced as a direct result of the
     6  blizzard of 1996 or the resulting flood emergency or if payment
     7  of the local share would exceed 40% of the most recently adopted
     8  annual budget of the political subdivision. The Commonwealth may
     9  require the adoption of appropriate flood control or storm water
    10  management plans as a condition of the waiver if the adoption of
    11  the plan does not present additional financial hardship.
    12     Section 4.  Any portion of the money appropriated in this act
    13  which remain unexpended, uncommitted, or unencumbered as of June
    14  30, 1997, shall automatically lapse as of that date.
    15     Section 5.  This act shall take effect immediately.
