AN ACT 1 Amending the act of April 9, 1929 (P.L.177, No.175), entitled 2 "An act providing for and reorganizing the conduct of the 3 executive and administrative work of the Commonwealth by the 4 Executive Department thereof and the administrative 5 departments, boards, commissions, and officers thereof, 6 including the boards of trustees of State Normal Schools, or 7 Teachers Colleges; abolishing, creating, reorganizing or 8 authorizing the reorganization of certain administrative 9 departments, boards, and commissions; defining the powers and 10 duties of the Governor and other executive and administrative 11 officers, and of the several administrative departments, 12 boards, commissions, and officers; fixing the salaries of the 13 Governor, Lieutenant Governor, and certain other executive 14 and administrative officers; providing for the appointment of 15 certain administrative officers, and of all deputies and 16 other assistants and employes in certain departments, boards, 17 and commissions; and prescribing the manner in which the 18 number and compensation of the deputies and all other 19 assistants and employes of certain departments, boards and 20 commissions shall be determined," adding and deleting the 21 names of certain boards of trustees for facilities under the 22 jurisdiction of the Department of Public Welfare, changing 23 the title of nine existing State schools and hospitals to 24 "center," and changing the name of a State hospital to 25 "center." 26 The General Assembly of the Commonwealth of Pennsylvania 27 hereby enacts as follows: 28 Section 1. As much of section 202 as applies to the 29 Department of Public Welfare, act of April 9, 1929 (P.L.177,
1 No.175), known as "The Administrative Code of 1929," amended 2 September 28, 1976 (P.L.1048, No.211), is amended to read: 3 Section 202. 1 * * * 2 Section 2. Section 401 of the act, amended July 9, 1976 3 (P.L.986, No.199), is amended to read: 4 Section 401. Boards of Trustees of State Institutions.--The 5 boards of trustees of each of the State institutions hereinafter 6 mentioned shall consist of nine members, and the head of the 7 department having supervision over the institution ex officio. 8 The terms of each member of each such board shall be six 9 years, and until his successor is appointed and qualified. 10 The terms of the first three members of all boards, the 11 members of which now serve for terms of four years, appointed by 12 the Governor on or after the third Tuesday of January, 1959, 13 shall expire on the third Tuesday of January, 1961. The terms of 14 the next three members appointed shall expire on the third 15 Tuesday of January, 1963. The terms of the next three members 16 appointed shall expire on the third Tuesday of January, 1965. 17 Their successors and all members of all boards, appointed to 18 succeed members who have served six year terms, shall be 19 appointed for terms of six years from the date of the expiration 20 of the preceding term. Vacancies happening before the expiration 21 of a term shall be filled for the unexpired term. 22 Five members of any such board shall constitute a quorum. 23 Each such board shall annually elect a president and vice- 24 president from among its members, and a secretary and treasurer 25 who need not be members of the board.
