                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for the offense of unlawful
     3     sale of dog or cat.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7517.  Unlawful sale of dog or cat.
     9     (a)  Offense defined.--A person who sells a dog or cat that
    10  is less than eight weeks old without its mother commits a
    11  summary offense and, upon conviction thereof, shall be punished
    12  by a fine of $250.
    13     (b)  Definition.--As used in this section, "person" means the
    14  owner or operator of a kennel or pet shop or other individual
    15  who sells dogs or cats to the public and who owns or operates a
    16  kennel or pet shop licensed by the Pennsylvania Department of
    17  Agriculture or the United States Department of Agriculture. The

     1  term shall not include the owner or operator of a nonprofit
     2  kennel as defined under the act of December 7, 1982 (P.L.784,
     3  No.225), known as the Dog Law.
     4     Section 2.  This act shall take effect in 60 days.
