        INTRODUCED BY LLOYD, M. COHEN, HARHAI, GODSHALL, GORDNER, ITKIN,
           JAMES, MAHER, RAMOS, READSHAW, TANGRETTI, TIGUE, TRAVAGLIO,
           TRELLO AND YOUNGBLOOD, SEPTEMBER 29, 1998

        REFERRED TO COMMITTEE ON CONSUMER AFFAIRS, SEPTEMBER 29, 1998

                                     AN ACT

     1  Amending Title 66 (Public Utilities) of the Pennsylvania
     2     Consolidated Statutes, providing for report by commission
     3     relating to network modernization implementation plans.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 3303 of Title 66 of the Pennsylvania
     7  Consolidated Statutes is amended by adding a subsection to read:
     8  § 3303.  Nonliability for enforcement of lawful tariffs and
     9             rates.
    10     * * *
    11     (c)  Report.--On or before April 15, 1999, the commission
    12  shall submit a report to the General Assembly on the exercise of
    13  its authority under this section. The report shall include at
    14  least a discussion of the following:
    15         (1)  The number of network modernization implementation
    16     plans approved by the commission.
    17         (2)  The specific steps which the commission is taking to
    18     assure that each local exchange telecommunications company is

     1     in compliance with the terms of its network modernization
     2     implementation plan, including its commitment for achieving
     3     universal broadband availability in rural, urban and suburban
     4     areas within its service territory.
     5         (3)  The broadband services proposed to be offered by
     6     each local exchange telecommunications company to residential
     7     customers in this Commonwealth, as specified in each network
     8     modernization implementation plan, and the time frame in the
     9     implementation plan for making such services available.
    10         (4)  The broadband services currently offered by each
    11     local exchange telecommunications company to residential
    12     customers in this Commonwealth.
    13         (5)  The manner in which and the extent to which
    14     deployment of broadband capability will impact, or has
    15     impacted, economic development in this Commonwealth.
    16         (6)  The impact of alternative forms of regulation on the
    17     financial performance of each local exchange
    18     telecommunications company and the extent to which any
    19     increased earnings have been reinvested in the Commonwealth's
    20     telecommunications infrastructure.
    21         (7)  The effect of alternative forms of regulation on
    22     competition.
    23     Section 2.  This act shall take effect immediately.
