                                     AN ACT

     1  Amending the act of May 23, 1945 (P.L.913, No.367), entitled, as
     2     amended, "An act relating to and regulating the practice of
     3     the profession of engineering, including civil engineering,
     4     mechanical engineering, electrical engineering, mining
     5     engineering and chemical engineering, the profession of land
     6     surveying and the profession of geology and constituent parts
     7     and combinations thereof as herein defined; providing for the
     8     licensing and registration of persons practicing said
     9     profession, and the certification of engineers-in-training
    10     and surveyors-in-training, and the suspension and revocation
    11     of said licenses, registrations and certifications for
    12     violation of this act; prescribing the powers and duties of
    13     the State Registration Board for Professional Engineers, Land
    14     Surveyors and Geologists, the Department of State and the
    15     courts; prescribing penalties; and repealing existing laws,"
    16     further providing for surveyors-in-training.

    17     The General Assembly of the Commonwealth of Pennsylvania
    18  hereby enacts as follows:
    19     Section 1.  Section 2(i) of the act of May 23, 1945 (P.L.913,
    20  No.367), known as the Engineer, Land Surveyor and Geologist
    21  Registration Law, amended December 13, 1979 (P.L.534, No.120),
    22  is amended to read:
    23     Section 2.  Definitions.--As used in this act--

    25     (i)  "Responsible Charge" means a position that requires

     1  initiative, skill and independent judgment, and implies such
     2  degree of competence and accountability gained by technical
     3  education and experience of a grade and character as is
     4  sufficient to qualify an individual to personally and
     5  independently engage in and be entrusted with the work involved
     6  in the practice of engineering or land surveying. This term does
     7  not include positions which require routine performance of
     8  subprofessional work such as auxiliary survey personnel [(unless
     9  acting as chief of party)] and drafting personnel. The holder of
    10  a surveyor-in-training certificate may assume responsible charge
    11  as chief of a survey party pursuant to subsection (d) of section
    12  4.3.

    14     Section 2.  Section 4.3 of the act is amended by adding a
    15  subsection to read:
    16     Section 4.3.  Procedure for Licensing as Professional Land
    17  Surveyor.--* * *
    18     (d)  No surveyor-in-training shall assume responsible charge,
    19  as defined in this act, of any field or office work, unless the
    20  licensed land surveyor under whose supervision the applicant's
    21  progressive experience is gained shall attest to the character
    22  and quality of said work by affixing his or her seal thereto.
    23     Section 3.  This act shall take effect in 60 days.
