                                     AN ACT

     1  Amending the act of June 24, 1976 (P.L.424, No.101), entitled
     2     "An act providing for the payment of death benefits to the
     3     surviving spouse or children of firemen or law enforcement
     4     officers killed in the performance of their duties," further
     5     providing for benefits.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The title and section 1, act of June 29, 1976
     9  (P.L.424, No.101), entitled "An act providing for the payment of
    10  death benefits to the surviving spouse or children of firemen or
    11  law enforcement officers killed in the performance of their
    12  duties," are amended to read:
    13                               AN ACT
    14  Providing for the payment of death benefits to the surviving
    15     spouse or children or certain dependent parents of firemen or
    16     law enforcement officers killed in the performance of their
    17     duties.
    18     Section 1.  A political subdivision shall pay to the
    19  surviving spouse, or, if there is no surviving spouse, the minor

     1  children, of a fireman or law enforcement officer of the
     2  political subdivision killed in the performance of his duties
     3  the sum of $25,000. When no spouse or minor children survive,
     4  the benefit shall be paid to the parent or parents of such
     5  fireman or officer in equal shares if the parent or parents had
     6  a one-third dependency on the income of such fireman or officer
     7  twelve months prior to the date of death. The benefit shall be
     8  payable whether or not the officer was killed within the
     9  corporate boundaries of the employing municipality.
    10     The Commonwealth of Pennsylvania shall pay to the surviving
    11  spouse, or, if there is no surviving spouse, the minor children
    12  of a State policeman or other law enforcement officer of the
    13  Commonwealth killed in the performance of his duties the sum of
    14  $25,000. The benefit shall be payable whether or not the officer
    15  was killed within the Commonwealth of Pennsylvania.
    16     Upon payment of this death benefit by a political
    17  subdivision, the political subdivision shall apply to the State
    18  Treasurer and be reimbursed for the total amount by the
    19  Commonwealth of Pennsylvania. Payments by the Commonwealth or
    20  reimbursement to the political subdivisions shall be made out of
    21  the General Fund of the Commonwealth of Pennsylvania.
    22     Section 2.  This act shall take effect in 60 days.
