AN ACT
Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
act relating to the public school system, including certain
provisions applicable as well to private and parochial
schools; amending, revising, consolidating and changing the
laws relating thereto," in pupils and attendance, providing
for attendance at intermediate units.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of March 10, 1949 (P.L.30, No.14), known
as the Public School Code of 1949, is amended by adding a
section to read:
Section 1327.4. Attendance at Intermediate Units.--(a) Each
intermediate unit shall establish an attendance policy designed
to accurately determine attendance for a child enrolled in a
school district who receives a portion of the child's education
from the intermediate unit.
(b) The policy under subsection (a) shall address how the
intermediate unit:
(1) coordinates procedures with the school district when a
child is truant under section 1333;

(2) participates in the school attendance improvement
conference under section 1333(b); and
(3) coordinates procedures with the school district when a
child is habitually truant under section 1333.1.
(c) If an intermediate unit provides all or substantially
all of a student's education, the intermediate unit shall be
responsible for all truancy procedures under sections 1333.1 and
1333.
(d) If an intermediate unit provides all or substantially
all of a student's education pursuant to a contract with a
school district, the contract shall include the manner in which
funding shall be required if a student is habitually truant
under section 1333.1.
Section 2. This act shall take effect in 60 days.
