AN ACT 1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated 2 Statutes, further providing for parking regulations relating 3 to persons with disabilities and disabled veterans. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Section 3354(d) and (e) of Title 75 of the 7 Pennsylvania Consolidated Statutes are amended to read: 8 § 3354. Additional parking regulations. 9 * * * 10 (d) [Handicapped persons] Person with a disability and 11 disabled veterans.-- 12 (1) When a motor vehicle bearing a [handicapped] person 13 with a disability or severely disabled veteran plate or 14 displaying a [handicapped] person with a disability or 15 severely disabled veteran parking placard as prescribed in 16 this title is being operated by or for the transportation of 17 the [handicapped] person with a disability or severely
1 disabled veteran, the driver shall be relieved of any 2 liability for parking for a period of 60 minutes in excess of 3 the legal parking period permitted by local authorities 4 except where local ordinances or police regulations provide 5 for the accommodation of heavy traffic during morning, 6 afternoon or evening hours. 7 (2) At the request of [any handicapped person] a person 8 with a disability or severely disabled veteran, local 9 authorities may erect on the highway as close as possible to 10 [their] the person's or veteran's place of residence a sign 11 or signs indicating that that place is reserved for [the 12 handicapped person] a person with a disability or severely 13 disabled veteran, that no parking is allowed there by others, 14 and that any unauthorized person parking there shall be 15 subject to a fine[.] and may be towed. The absence of a sign 16 stating the penalty amount indicated in subsection (f) at 17 parking spaces designated with a handicapped parking symbol 18 shall not preclude the enforcement of this subsection. 19 (3) (i) Except for persons parking vehicles lawfully 20 bearing a [handicapped] person with a disability or 21 severely disabled veteran registration plate or 22 displaying a [handicapped] person with a disability or 23 severely disabled veteran parking placard when such 24 vehicles are being operated by or for the transportation 25 of a [handicapped] person with a disability or a severely 26 disabled veteran, no person shall park a vehicle on 27 public or private property reserved for a [handicapped] 28 person with a disability or severely disabled veteran 29 which property has been so posted in accordance with 30 departmental regulations. 1 stating the penalty amount indicated in subsection (f), a 2 sign indicating that vehicles in violation of the 3 subsection may be towed and require that signs be 4 replaced when they become either obsolete or missing with 5 all costs to replace the necessary signs to be borne by 6 the persons responsible for signing the particular 7 location. Any] Regulations shall include requirements for 8 signs stating the penalty amount indicated in subsection 9 (f) and signs stating that vehicles in violation of this 10 subsection may be towed. The absence of such signs at 11 parking spaces designated with a handicapped parking 12 symbol shall not preclude the enforcement of this 13 subsection. A vehicle which is unlawfully parked in a 14 designated [handicapped] person with a disability parking 15 area may be removed from that area by towing and may be 16 reclaimed by the vehicle owner upon payment of the towing 17 costs. 18 (ii) Local authorities shall have the power and may, 19 by ordinance or resolution, authorize [handicapped 20 persons] a person with a disability and severely disabled 21 veterans to issue statements to violators or violating 22 vehicles for violation of subparagraph (i). The form of 23 the statement shall be as prescribed by the local 24 authorities. 25 (e) Unauthorized use.--An operator of a vehicle bearing a 26 [handicapped] person with a disability or severely disabled 27 veteran plate or displaying a [handicapped] person with a 28 disability or severely disabled veteran parking placard shall 29 not make use of the parking privileges accorded to [handicapped 30 persons] a person with a disability and severely disabled 20020H2606B3784 - 3 -
1 veterans under subsection (d)(3) unless the operator is 2 [handicapped] a person with a disability or a severely disabled 3 veteran or unless the vehicle is being operated for the 4 transportation of a [handicapped] person with a disability or 5 severely disabled veteran. 6 * * * 7 Section 2.
