AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, in firearms and other dangerous

3

articles, providing for reporting the purchase and transfer

4

of firearm ammunition to the Pennsylvania State Police; and

5

prescribing a penalty.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Title 18 of the Pennsylvania Consolidated

9

Statutes is amended by adding a section to read:

10

§ 6128.  Reporting the purchase and transfer of firearm

11

ammunition.

(a)  Duty of seller.--

13

(1)  A seller of firearm ammunition shall provide a

14

report to the Pennsylvania State Police within five business

15

days of selling 500 or more rounds of ammunition to a

16

consumer during a single transaction.

17

(2)  Paragraph (1) shall not apply to a sale of firearm

18

ammunition between retailers.

19

(b)  Transfers.--An individual who transfers 500 rounds or

more of firearm ammunition to another individual shall report

2

the transfer to the Pennsylvania State Police within five

3

business days of the transfer.

(c)  Internet purchases.--An individual who purchases 500

5

rounds or more of firearm ammunition on the Internet shall

6

report the purchase to the Pennsylvania State Police within five

7

business days of the purchase.

(d)  Contents of seller's report.--A seller who is required

9

to submit a report as provided in subsection (a) shall include

10

the following information in the report:

11

(1)  The seller's business name, address and phone

12

number.

13

(2)  The individual seller's name.

14

(3)  The consumer's name.

15

(4)  The consumer's street address.

16

(5)  The consumer's date of birth.

17

(6)  The type of ammunition purchased.

18

(7)  The amount of ammunition purchased.

19

(8)  The form of payment used for the purchase.

20

(9)  Any additional information that the Pennsylvania

21

State Police may deem necessary.

22

(e)  Contents of transferee's or Internet purchaser's

23

report.--A transferee or Internet purchaser who is required to

24

submit a report as provided in subsection (b) or (c) shall

25

include the following information in the report:

(1)  The transferor's or Internet seller's business name,

27

address and phone number.

28

(2)  The transferor's or Internet seller's individual

29

name.

(3)  The transferee's or Internet purchaser's name.

(4)  The transferee's or Internet purchaser's street

address.

(5)  The transferee's or Internet purchaser's date of

4

birth.

(6)  The type of ammunition purchased or transferred.

6

(7)  The amount of ammunition purchased or transferred.

(8)  For an Internet purchase, the form of payment used

8

for the purchase.

(9)  Any additional information that the Pennsylvania

10

State Police may deem necessary.

(f)  Recordkeeping requirements.--The Pennsylvania State

12

Police shall designate a person to file all reports received

13

under this section and shall provide a copy of the reports to

14

the appropriate chief law enforcement officer of the

15

municipality where the sale, transfer or Internet purchase of

16

the firearm ammunition occurred. The chief law enforcement

17

officers of the municipalities shall maintain all documentation

18

provided to them to review as deemed necessary.

19

(g)  Penalty.--An individual who violates subsection (a),

20

(b), (c), (d) or (e) commits a misdemeanor of the third degree.

21

Section 2.  This act shall take effect in 60 days.
