                                     AN ACT

     1  Relating to employees of the General Assembly.

     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4     Section 1.  This act shall be known and may be cited as the
     5  "Legislative Employees Act."
     6     Section 2.  The following words and phrases when used in this
     7  act shall have, unless the context clearly indicates otherwise,
     8  the meanings given to them in this section:
     9     "Employee."  Any person employed by an employer of the House
    10  of Representatives and Senate but shall not include part-time
    11  pages, persons employed on a contract basis for specialized
    12  services, and persons employed by a member of the General
    13  Assembly to be paid from such member's accountable expense
    14  account.
    15     "Employer."  The elected officers of the House of
    16  Representatives and Senate, elected leadership of the House of
    17  Representatives and Senate, committee chairmen of standing and

     1  special committees of the House of Representatives and Senate,
     2  Legislative Commissions, Legislative Bureaus and Legislative
     3  Agencies.
     4     "Job classification."  A word description of the job itself.
     5     "Job description."  A word description of the duties of each
     6  job classification and shall include the expected hours and
     7  places of employment.
     8     "Personnel record."  A written record of the employee's name,
     9  residence, social security number, current and prior job
    10  classification, initial date of employment, increment dates and
    11  such other information as the employer deems necessary.
    12     "Salary schedule."  A tabulation of salaries for each job
    13  classification and shall include annual increments, employment
    14  benefits, including sick leave, maternity leave and vacation,
    15  and overtime pay, if applicable.
    16     Section 3.  On or before November 30, 1978, the Rules
    17  Committees of the House of Representatives and the Senate shall,
    18  by separate resolution, adopt job classifications, job
    19  descriptions and salary schedules for each job classification,
    20  for all employees of the House of Representatives and the
    21  Senate.
    22     Section 4.  Beginning December 1, 1978, each employer shall
    23  submit in writing to the Chief Clerk of the House of
    24  Representatives or to the Secretary of the Senate, as the case
    25  may be, a list of the names, home addresses of all persons to be
    26  employed together with an assignment of such persons to a
    27  specific job classification, at a salary selected from the
    28  salary schedule, adopted pursuant to section 3. The employer
    29  shall also advise in writing the Chief Clerk of the House of
    30  Representatives or the Secretary of the Senate, as the case may

     1  be, the specific appropriation to the House of Representatives,
     2  or Senate or its officers, committees, commission, boards or
     3  agencies, upon which such salary shall be paid. Thereafter, no
     4  salary shall be paid to any employee, except by the State
     5  Treasurer in accordance with the act of April 9, 1929 (P.L.343,
     6  No.176), known as "The Fiscal Code," as is now provided for all
     7  other State employees.
     8     Section 5.  It shall be the duty of each employer to notify
     9  the Chief Clerk of the House of Representatives or the Secretary
    10  of the Senate, as the case may be, in writing from time to time
    11  of any changes, additions or deletions to the list of employees
    12  provided for in section 4.
    13     Section 6.  It shall be the duty of the Chief Clerk of the
    14  House of Representatives and the Secretary of the Senate to
    15  maintain personnel records, which records shall be preserved for
    16  the duration of each employee's term of employment and two
    17  calendar years thereafter. Each employee's personnel record
    18  shall be open to inspection only by such employee or a duly
    19  authorized representative of such employee's employer upon
    20  reasonable request.
    21     Section 7.  The act of January 10, 1968 (1967 P.L.925,
    22  No.417), entitled "An act relating to officers and employes of
    23  the General Assembly; fixing the number, qualifications,
    24  compensation, mileage and duties of the officers and employes of
    25  the Senate and of the House of Representatives; providing for
    26  their election or appointment, term of office, or of service,
    27  removal and manner of filling vacancies; fixing the salary of
    28  the Director of the Legislative Reference Bureau; providing for
    29  compilation of lists of employes," is repealed insofar as it is
    30  inconsistent herewith.
